【摘要】：随着互联网在日常生活中的应用不断普及和以支付宝为主的网络支付渠道的畅通,人们已经逐渐接受网络交易模式,并逐渐成为人们购买商品的主要途径。在网络交易模式下,销售者以更加低廉的价格向消费者提供更加丰富的商品,消费者的选择范围扩大,并且交易方式更加简便。但当前网络交易模式并不是完美无缺的,由于我国相关立法不完善、政府监管不力、以及消费者与销售者信息不对称等原因,造成了网络交易模式下消费者权益被侵害现象多发,并且消费者维权困难的局面。大力发展网络交易模式不仅能够给人们提供便利,对社会乃至整个国家都有非常重要的意义。我国政府也提出了“互联网+”的发展规划,发展网络交易模式有利于我国经济发展,有利于促进企业发展壮大,有助于促进群众创业,增加就业,维护社会稳定。但当前我国的法律体系中并没有一部专门的法律来对此进行规范。规范网络交易模式的相关法律规范散见于《中华人民共和国消费者权益保护法》、《中华人民共和国产品质量法》、《中华人民共和国民法通则》、《中华人民共和国合同法》、《中华人民共和国侵权责任法》中。我们要加强对网络交易模式的规范,保护网络交易模式下的消费者,首先就是要完善相关立法,使得各项规范工作有法可依。为了阐述“网络交易模式下对消费者权益保护”这一问题,本文通过五章来进行说明:第一部分为网络交易模式下消费者权益的概念和特征。通过对网络交易模式的定义、现状、特点和网络消费者概念、权利、其与普通消费者的区别来进行分析,明确相关术语,为下文的具体问题展开及对策的提出打下基础。第二部分为我国网络交易模式下消费者权益保护的现状、问题及原因。通过对当前我国网络交易模式下消费者权益的法律保护的立法现状、存在问题、原因分析,来全面系统的对我国相关的法律进行梳理,是下文所提出解决对策建议的前提。第三部分为国外网络交易模式下消费者权益保护的现状及经验。通过对美国、日本、联合国、亚太经合组织等国家和国际组织在网络交易模式下消费者权益保护这一问题上的立法现状进行分析,总结出完善我国网络交易模式下消费者权益的法律保护可借鉴的经验。第四部分为完善我国网络交易模式下消费者权益保护的建议。通过以上对外国经验的借鉴,我国立法现状的分析,提出完善我国网络交易模式下消费者权益的法律保护的建议。第五部分为结语。
[Abstract]:With the popularization of the Internet in daily life and the smooth flow of payment channels based on Alipay, people have gradually accepted the mode of online trading and become the main way for people to buy goods.In the online trading mode, the sellers provide consumers with more abundant goods at lower prices, and the choice of consumers is expanded, and the way of trading is more convenient.However, the current online trading model is not perfect. Due to imperfect legislation, weak government supervision and asymmetric information between consumers and sellers, and so on,It results in the phenomenon that consumers' rights and interests are infringed frequently under the network trading mode, and consumers' rights protection is difficult.The development of network transaction mode not only can provide convenience for people, but also has very important significance for society and even the whole country.The government of our country has also put forward the development plan of "Internet". The development of network transaction model is beneficial to the economic development of our country, to the development of enterprises, to the promotion of entrepreneurship among the masses, to the increase of employment and to the maintenance of social stability.However, there is not a special law to regulate this in the current legal system of our country.Relevant legal norms regulating the mode of online transactions are scattered in the Law of the people's Republic of China on Protection of Consumer Rights and interests, the Law of the people's Republic of China on the quality of products, the General principles of Civil Law of the people's Republic of China, and the contract Law of the people's Republic of ChinaIn the Law of the people's Republic of China on Tort liability.We should strengthen the standardization of the network transaction mode and protect the consumers under the network transaction mode. First, we should perfect the relevant legislation to make the standard work according to the law.In order to expound the problem of "protecting consumers' rights and interests under the network trading mode", this paper explains through five chapters: the first part is the concept and characteristics of consumers' rights and interests under the network transaction mode.By analyzing the definition, current situation, characteristics, concept and rights of online consumers, and the differences between them and ordinary consumers, this paper clarifies the relevant terms, and lays a foundation for the following concrete problems and countermeasures.The second part is the current situation, problems and reasons of consumer rights and interests protection under the network transaction mode in our country.By analyzing the current legislative situation, existing problems and reasons of the legal protection of consumers' rights and interests under the current mode of network trading in China, it is the premise of the following countermeasures and suggestions to make a comprehensive and systematic analysis of the relevant laws of our country.The third part is the current situation and experience of consumer rights and interests protection under foreign network trading mode.Through the analysis of the current legislative situation of countries and international organizations such as the United States, Japan, the United Nations, APEC and other countries and international organizations on the issue of consumer rights and interests protection under the network trading model,Summing up the experience of consummating the legal protection of consumer's rights and interests under the network transaction mode in our country.The fourth part is the suggestion of consummating the consumer rights and interests protection under the network transaction mode of our country.Based on the experience of foreign countries and the analysis of the current situation of legislation in China, the author puts forward some suggestions on how to improve the legal protection of consumers' rights and interests under the mode of network transaction in China.The fifth part is the conclusion.
