民间文学艺术作品著作权法律保护问题研究

【摘要】:民间文学艺术作品的产生需要一个国家或地区的人们拥有富足的物质生活条件与深厚的生活情感。疆域之广阔、历史之悠久、人文情怀之深厚以及经济之逐步发达,决定了我国有着富饶的民间文学艺术作品资源。随着信息沟通便利程度的提高,越来越多的中华民间文学艺术作品走入人们的视野,其特有魅力使它创造出了不少于现代作品的经济价值。于是,商人对其进行商业利用,索取其价值;创作者直接用其冠己之名出版发行赚取稿酬;有的甚至被国外行为艺术家以猎奇歪曲的方式展出并依此获取名声与金钱。这些现象的发生,对民间文学艺术作品所有人造成了精神损害,对民间文学艺术作品本身也是一种破坏,而法律的缺失导致这些行为无法管控。从中获益者不仅未将通过这些行为所获取的经济利益分享于民间文学艺术作品的所有人,而且也未将其所获利益用于民间文学艺术作品的传承与发展。鉴于公法保护不能直接惠及于民间文学艺术作品所有人,而民间文艺术作品所有人又是民间文学艺术作品传承与发展的关键,故唯有赋予民间文学艺术作品所有人以私权并予以保护,才能直接规制上述不当行为,以保护民间文学艺术作品及其所有人的持有地位。全文共分五个部分。绪论部分简要概括了此课题研究的选题背景及意义,对相关研究进行了综述,介绍了课题研究的主要内容和研究方法。第一章,民间文学艺术作品及其保护的价值。首先梳理并分析了有关民间文学艺术的法律文件与民族学等相关学科对民间文学艺术作品涵义的界定和特征的描述,通过对分析结果的限定,明确了本文研究的民间文学艺术作品的具体指向;其次,在对民间文学艺术作品所有人的权利期望进行分析的基础上,论证了民间文学艺术作品保护的经济价值与其他价值,基于其当前面临的威胁,明确指出其应受到著作权的保护。第二章,民间文学艺术作品著作权保护的理论困惑与法律缺失。一是通过对学界观点与主张的梳理,分析了民间文学艺术作品未能纳入著作权保护的原因,即基于对民间文学艺术作品定义、特征的含混表达,导致其与一般著作权法理论之间的矛盾;二是对现有国内外法律文件对其著作权保护的不完善性逐一进行了评析;三是对由此不完善性在学界引发的诸多非著作权保护模式的局限性进行解析。第三章,民间文学艺术作品著作权法律保护的理论解答。通过法社会学理论与著作权起源的分析,针对民间文学艺术作品著作权法律保护的必然性与合理性、主客体构造、保护期限,以及保护的目的与权利性质等理论困惑等,分别进行了解答,并对现行的著作权制度进行了反思。第四章,民间文学艺术作品著作权法律保护制度建构。通过对矛盾与困惑的化解,以及民间文学艺术作品与现代文学艺术作品的差异,提出不能将民间文学艺术作品完全置于现行著作权法律保护的观点,建议国务院尽快出台《民间文学艺术作品著作权保护条例》,并对其保护原则及保护规则等内容提出了自己的观点。
[Abstract]:The production of folk literature and art needs the rich material living conditions and deep life emotions in a country or region. The vast territory, the long history, the profound humanistic feelings and the gradual development of the economy have determined the resources of rich folk arts and art works in our country. With the convenience of information communication As a result, more and more Chinese folk literature and art works have entered people's field of vision. Their unique charm makes it not less than the economic value of modern works. The occurrence of these phenomena is a spiritual damage to all the people of folk literature and art, and it is also a damage to the works of folk literature and art itself, and the lack of law leads to these actions that can not be controlled. The benefit is shared by all people in the works of folk literature and art, and it has not been used for the inheritance and development of the works of folk literature and art. In view of the fact that the protection of public law can not directly benefit all the people of the folk literature and art works, the people of the folk art works are the key to the inheritance and development of the literary and artistic works among the people. Only by endowing the folk literature and art works with the private rights and protection, can we directly regulate the above misconduct to protect the works of folk literature and art and the holding status of all the people. The full text is divided into five parts. The introduction briefly summarizes the background and significance of the topic research, summarizes the related research, and introduces the related research. The two is to analyze the imperfection of the copyright protection of the existing domestic and foreign legal documents. The three is the analysis of the limitations of many non copyright protection modes caused by the imperfection in the academic circles. The third chapter, the theoretical solution of the legal protection of the copyright of the folk literature and art works. The analysis of the origin of rights, in view of the inevitability and rationality of the legal protection of the copyright of the folk literature and art works, the structure of the subject and object, the duration of protection, the theoretical puzzles of the protection and the nature of rights, and so on, and the reflection on the current copyright system, the fourth chapter, the legal protection of the copyright of the folk literature and art works. By dissolving the contradictions and puzzles, as well as the differences between the works of folk literature and art and the works of modern literature and art, it is suggested that the folk literature and art works can not be completely placed in the current legal protection of copyright, and the State Council is suggested to publish the Copyright Protection Ordinance of the folk literature art works as soon as possible and to protect it. And the protection rules put forward their own views.
