劳务派遣中的雇主替代责任研究

【摘要】:劳务派遣是一种最初表现为“人力租赁”,进一步发展成为“借用雇员”,最后在我国被定名为“劳务派遣”的一种涉及到三方主体,即劳务派遣单位、被派遣劳动者、接受被派遣劳动者的单位的特殊的用工方式,其不同于一般的仅仅涉及两方主体的雇佣关系。其具体指的是由劳务派遣机构与被派遣的劳动者订立劳动合同,然后将劳动者派向其他用工单位,再由该实际用工单位向派遣机构支付一笔服务费用的一种用工形式。劳动力给付的事实发生于被派遣的劳动者与实际用工单位之间,实际用工单位向劳务派遣机构支付服务费,劳务派遣机构向被派遣的劳动者支付劳动报酬。劳务派遣最初出现在20世纪20年代的美国,随后因为其程序简单、便于管理、符合经济发展的特点,在20世纪70年代得到世界上多个国家的广泛运用。20世纪90年代劳务派遣在我国劳动力市场上的各个领域得到了广泛的运用,其对于推动我国经济的发展以及劳动者就业难问题的解决起到了不可缺少的作用。但是由于这种特殊的用工方式在我国发展的时间较短,人们对它的认识较少,所以在我国有关于其的法律规定较少而且相关的法律规定较为粗疏,也因为此进一步导致了其在我国实践中实施运用的时候存在很多的问题。劳务派遣中的雇主替代责任是指当被派遣的劳动者在为接受被派遣劳动者的单位工作的过程之中造成他人损害时,劳务派遣单位、接受被派遣劳动者的单位两者作为被派遣劳动者的两个“雇主”应该代替被派遣的劳动者承担侵权责任的问题。本文主要是通过文献研究、比较研究、归纳解析等各种研究方法,对劳务派遣中雇主替代责任的基础理论进行分析,阐述了域外劳务派遣中雇主替代责任及对我国的借鉴意义,并分析了我国劳务派遣中雇主替代责任的立法现状以及从《侵权责任法》的视角剖析立法存在的不足,最后提出我国劳务派遣中有关雇主替代责任的完善建议。从而为我国劳务派遣中雇主替代责任的立法完善出谋献策,以促进我国的劳动力市场更加规范。本论题包括引言、正文五个部分以及结束语:引言部分,这个部分主要介绍了本论题的课题来源、课题研究的目的及意义、本论题的国内外研究现状、本论题的研究方法等内容;正文第一部分,主要从劳务派遣概述、雇主替代责任概述、劳务派遣中三方法律关系辨析这三个方面简要阐述了有关劳务派遣中雇主替代责任的基本理论;正文第二部分,主要从劳务派遣中雇主替代责任的理论基础、劳务派遣中雇主替代责任的归责原则这两个方面对劳务派遣中雇主替代责任的理论基础与归责原则进行了简要的阐述;正文第三部分,主要阐述英国、法国、美国、我国台湾地区有关劳务派遣中雇主替代责任的相关规定以及各个区域中雇主替代责任相关规定对于我国劳务派遣中雇主替代责任的借鉴意义;正文第四部分,主要是重点论述我国劳务派遣中雇主替代责任的立法现状以及其在立法上存在的不足之处;正文第五部分,主要是以《侵权责任法》为视角,针对我国劳务派遣中雇主替代责任立法上的不足提出相对应的完善建议,以至于我国有关劳务派遣中雇主替代责任的相关法律法规可以得到更好的完善,可以更好地促进我国劳务派遣的发展;结束语部分,这个部分主要是对本论题进行总结。
[Abstract]:Labor dispatch is a kind of special labor mode, which is different from the general one, which is first expressed as "human lease", and it is further developed into "borrowing employees", and in the end it is called "labor dispatch", which involves three parties, that is, the labor dispatch unit, the dispatched laborers, and the units that are sent to the dispatched workers. The employment relationship involving the two party body, which refers to a labor contract which is made by the labor dispatch agency and the dispatched worker, and then sends the labourer to other employment units, and then the actual employment unit pays a service fee to the dispatch agency. The facts of the labor power supply occur in the dispatched labor. Between the actual employment unit and the actual employment unit, the actual employment unit paid the service fee to the labor dispatch agency. The labor dispatch agency paid the labor remuneration to the dispatched workers. The labor dispatch was first appeared in the United States in 1920s, and then because of its simple procedure, easy management, the characteristics of economic development, and the world in 1970s. The extensive use of many countries in the world has been widely used in various fields in the labor market of China in the 90s.20 century. It has played an indispensable role in promoting the development of China's economy and the difficult problem of employment for workers. However, this special mode of employment has been developed in our country. Relatively short, people are less aware of it, so there are less laws and regulations about it in our country and the relevant legal provisions are relatively rough, because this further leads to the existence of many problems when it is applied in our country. The replacement responsibility of the employer in the labor dispatch refers to the acceptance by the dispatched workers for acceptance. In the course of the work of the dispatched workers, the labor dispatch unit and the unit of the dispatched workers, which accept the two "employers" of the dispatched workers, should replace the dispatched workers to take on the tort liability. This article is mainly through literature research, comparative research, induction and analysis and so on. The research method analyzes the basic theory of replacement responsibility of employers in labor dispatch, expounds the replacement responsibility of employers in the extraterritorial labor dispatch and the reference significance to our country, and analyzes the legislative status of the employer's replacement responsibility in our labor dispatch and analyzes the shortcomings of the legislation from the perspective of the tort liability law. Finally, I put forward that This thesis includes introduction, five parts of the text and the end: Introduction: this part mainly introduces the topic of this thesis. Source, the purpose and significance of the research, the current research situation at home and abroad, the research method of the thesis, and so on. The first part of the text, mainly from the summary of labor dispatch, the overview of the employer's replacement responsibility, and the analysis of the legal relations between the three parties in the labor dispatch, briefly expounds the basic theory of the employer's replacement responsibility in the labor dispatch; The second part of the text mainly expounds the theoretical basis and the principle of the replacement responsibility of employers in the two aspects of the replacement responsibility of the employer in the labor dispatch and the principle of the liability for the replacement of employers in the labor dispatch. The third part of the text mainly expounds the UK, France, the United States and the Taiwan land of our country. In the fourth part of the text, the fourth part of the text mainly discusses the legislative status of employer replacement responsibility in our labor dispatch and its shortcomings in legislation. The fifth part of the text is mainly based on the "tort liability law" as the angle of view, and puts forward the relative perfect suggestions on the shortage of employers' alternative responsibility in the labor dispatch of our country, so that the relevant laws and regulations about the replacement responsibility of employers in our labor dispatch can be better perfected, which can better promote the labor service school in our country. In the concluding part, this part mainly summarizes the topic.
