【摘要】：影视作品是一种能够给观众带来视觉和听觉双重艺术感受的具有综合性的艺术形式。随着影视行业的迅猛发展,影视作品的独创性成为影视作品能否成功的关键因素,可惜这个道理并不为大家所接受,造成抄袭、剽窃成风。这种被称之为"搭便车"的行为,极容易挫伤原创权利人的创作积极性,也阻碍影视行业的发展,应当引起高度重视。在影视作品侵权案件中,影视作品的独创性判断成为司法实践中的难题,法院在审理过程中并未就独创性的标准、认定主体等达成统一意见。因此,对影视作品独创性进行研究是十分有必要的。以影视作品的独创性研究为出发点,希望可以为司法实践提供理论支持,从法律上维护著作权人的合法权益,实现利益平衡。本文主要分为四个部分对影视作品的独创性进行分析。第一部分是以影视作品独创性的概述为切入点,对影视作品和独创性的概念进行界定,并在明晰概念的基础上分析影视作品独创性的作用,为后文的论述进行铺垫。第二部分是通过考察并总结分析国内外的作品独创性的标准,得到影视作品独创性标准为独立完成、创造性和针对性的创作程度的启示。第三部分主要是通过国内外相关的案例,论述在具体的司法实践中,国内和国外对于影视作品独创性的认定,并对国内外的认定进行分析,总结影视作品独创性认定的须遵循的原则及适用的认定方法和认定主体。第四部分主要是论述我国影视作品独创性的保护,通过分析我国目前使用的保护方式的现状和局限性,提出完善我国影视作品独创性保护的建议。
[Abstract]:Film and TV works are a comprehensive art form which can bring both visual and auditory artistic feelings to the audience. With the rapid development of the film and television industry, the originality of the film and television works becomes the key factor to the success of the film and television works. Unfortunately, this principle is not accepted by everyone, resulting in plagiarism and plagiarism. This kind of behavior called "hitchhiking" can easily dampen the creative enthusiasm of original right holders and hinder the development of film and television industry. In the case of infringement of film and television works, the judgment of originality of film and television works has become a difficult problem in judicial practice, and the court has not reached a unified opinion on the standard of originality and the determination of the subject in the process of trial. Therefore, it is necessary to study the originality of film and television works. Based on the original research of film and television works, the author hopes to provide theoretical support for judicial practice, protect the legal rights and interests of copyright owners and realize the balance of interests. This paper is divided into four parts to analyze the originality of film and television works. The first part is to define the concept of film and television works and originality based on the outline of the originality of film and television works, and analyze the role of originality of film and television works on the basis of clear concepts, so as to pave the way for the later discussion. The second part is through the inspection and the summary analysis domestic and foreign works originality standard, obtains the movie and television work originality standard for the independent completion, the creativity and the pertinence creation degree enlightenment. The third part mainly through the domestic and foreign related cases, discusses in the concrete judicial practice, domestic and foreign regarding the movie and television work originality confirmation, and carries on the analysis to the domestic and foreign confirmation, This paper summarizes the principles to be followed and the methods and subjects to be followed for the originality of film and television works. The fourth part mainly discusses the protection of the originality of the film and television works in our country. By analyzing the present situation and limitation of the protection methods used in our country, the author puts forward some suggestions on how to perfect the protection of the originality of the film and television works in our country.
