城镇化进程中未成年人就业行为的二元悖论:强制与自愿

【摘要】：世界各国均明令禁止未成年人就业,我国也严禁十六周岁以下的未成年人就业,但在城镇化发展进程中,我国未成年就业者的就业行为具有明显的主体自愿性,形成了国家的强制性禁止和主体自愿性之间的二元悖论。未成年人就业过程中主体自愿性的形成与当前我国劳动力市场用工荒的常态化、部分农村地区的贫困落后、教育实现社会流动的功能弱化以及打工文化的强势渗透等因素相关。未成年人就业过程中主体自愿性问题的化解,需要国家在严格执行禁止未成年人就业的法律法规的基础上,推动我国产业结构的优化升级,减少对普通劳动者的需求性依赖;推动城乡一体化发展,加大对农村贫困地区扶贫力度;均衡城乡教育发展,促进教育公平,提升教育实现纵向社会流动的功能。
[Abstract]:All countries in the world explicitly prohibit minors from obtaining employment, and our country also prohibits minors under the age of 16 from getting employed. However, in the process of urbanization, the employment behavior of minors in China is obviously voluntary. It forms the dualistic paradox between the compulsory prohibition of the state and the voluntary nature of the subject. The formation of voluntary subject in the process of minors' employment is related to the normalization of labor shortage in China's labor market, the poverty and backwardness in some rural areas, the weakening of the function of social mobility in education and the strong infiltration of working culture. In order to resolve the voluntary problems in the process of minors' employment, it is necessary for the state to promote the optimization and upgrading of the industrial structure of our country on the basis of strictly enforcing the laws and regulations prohibiting the employment of minors, so as to reduce the demand dependence on ordinary workers. Promoting the integration of urban and rural areas, increasing poverty alleviation in rural poor areas, balancing the development of urban and rural education, promoting education equity, and enhancing the function of education to realize vertical social mobility.
