论界定商标侵权使用行为的两步审查法

【摘要】：商标使用行为的功能界定法具有抽象性,难以清晰界定;将商标使用行为限定于流通领域的观点值得商榷;商标使用行为具有行为指向性,独立于混淆可能性的判断,后者具有事实依赖性。技术服务行为为认定商标使用行为、划分商标直接侵权和间接侵权提供了启示。个案中对商标使用行为的审查,应当分两步进行,第一步审查该行为是否乃获取"经济优势"的行为,即是否属于商业行为;第二步审查行为人是否利用商标推广其商品或服务,即是否在商品或服务与商标之间建立了"经济关联"。
[Abstract]:The function definition of trademark use is abstract, so it is difficult to define clearly; the viewpoint of limiting trademark use to circulation is debatable; the behavior of trademark use has the directionality of behavior, independent of the judgment of the possibility of confusion. The latter is factually dependent. The act of technical service provides enlightenment for the identification of trademark use and the division between direct and indirect trademark infringement. The examination of trademark use should be divided into two steps: the first step is whether the act is an "economic advantage", that is, whether it is a commercial act; The second step is to examine whether the actor uses the trademark to promote his goods or services, that is, to establish an "economic connection" between the goods or services and the trademark.
