美术作品的抄袭认定研究

【摘要】:美术作品抄袭的认定作为一个理论问题被提出已不可回避,然而,国内学界以此为专门研究对象进行系统研究的成果并不多见。本文旨在运用规范分析与比较分析的方法,同时引入鉴赏美学的相关理论,尝试重新构建美术作品抄袭的司法认定标准。本文首先探讨了美术作品抄袭领域之典型案例,提出理论上抄袭认定的三个问题,即何为著作权保护之美术作品、美术作品的“思想”与“表达”的界定不明以及美术作品的“实质相似”认定不清,而前者涉及“独创性”的认定混乱问题。而这些问题源于,现有美术作品抄袭由被告作品是否具有“独创性”来认定,回避了抄袭认定的基础理论。回应前述美术作品的抄袭认定问题,笔者尝试对美术作品抄袭认定问题的相关理论重新进行审视。在对“抄袭”一词的界定中,笔者认为抄袭分为抄袭与不法抄袭,著作权法定义的侵权为不法抄袭的行为;并将抄袭与剽窃、临摹进行对比区分,梳理著作权法上作品抄袭认定之基础理论,提出引入台湾和美国地区对抄袭认定所运用的认定方法。进而,对美术作品与其他作品比较,发现其在抄袭认定问题上的特殊性,笔者认为融入鉴赏理论对美术作品抄袭认定极为重要,进而阐述鉴赏理论在美术作品抄袭认定中的适用。笔者尝试利用美术作品的鉴赏要素来判断抄袭行为,从而限定“独创性”这一范畴在抄袭认定中的作用,即“独创性”在认定美术作品抄袭的功能更多的体现在美术作品的认定中,而非“实质相似”的认定。最后,在已有理论的基础上,笔者对美术作品的抄袭认定的标准进行重构。厘清思想表达二分法中“表达”的内涵、“实质相似”认定以及例外排除等核心要素的层次。进而得出全新的美术作品抄袭认定审查架构:作品满足美术作品之构成要件→达到鉴赏要素要求构成表达抄袭→接触与实质相似的认定→例外排除。
[Abstract]:The identification of plagiarism of art works as a theoretical issue has been put forward, however, the domestic academic circles as a special research object of systematic research results are rare. The purpose of this paper is to use the methods of normative analysis and comparative analysis, and at the same time to introduce the relevant theory of appreciation aesthetics, and try to reconstruct the judicial standard of plagiarism of art works. This paper first discusses the typical cases in the field of plagiarism of art works, and puts forward three problems of theoretical plagiarism, that is, what is the copyright protection of art works? The definition of "thought" and "expression" of art works is unclear and the "substantial similarity" of art works is not clear, while the former involves the confusion of "originality". These problems come from whether the defendant's works are original or not, and avoid the basic theory of plagiarism. In response to the problem of plagiarism, the author tries to re-examine the theory of plagiarism. In the definition of "plagiarism", the author thinks that plagiarism is divided into plagiarism and illegal plagiarism, the infringement defined by copyright law is illegal plagiarism, and plagiarism are compared and distinguished. This paper combs the basic theory of plagiarism in copyright law and puts forward the identification methods of plagiarism in Taiwan and America. Furthermore, comparing with other works, the author finds out the particularity of the problem of plagiarism. The author thinks that it is very important to integrate the theory of appreciation to identify the plagiarism of art works. Then expound the application of appreciation theory in the identification of plagiarism of art works. The author tries to use the appreciation elements of art works to judge the act of plagiarism, so as to limit the role of the category of "originality" in the identification of plagiarism. That is, "originality" is more embodied in the identification of art works than in the identification of "substantial similarity" in identifying the function of plagiarism in art works. Finally, on the basis of existing theories, the author reconstructs the standard of plagiarism of art works. It clarifies the connotation of "expression" in the dichotomy of thought expression, the level of core elements such as "substantial similarity" and exception exclusion. Finally, the author draws a new examination framework of plagiarism in art works: the works meet the requirements of the elements of appreciation of works of fine arts, and the identification that expression plagiarism contact is similar to the essence is excluded.
