【摘要】：本文在探讨医疗过错的概念与特点的基础上,采用比较分析方法和规范分析方法,研究医疗过错的判断标准与具体认定规则,进一步分析现有医疗过错类型化理论及其存在问题：尤其结合典型医疗纠纷案例为基础,沿着医疗环节进程中的具体注意义务,对医疗过错行为进行类型化,以期对司法实践和医院依法管理、提高患者安全提供有益帮助。
[Abstract]:On the basis of discussing the concept and characteristics of medical fault, this paper uses comparative analysis method and normative analysis method to study the judgment standard and specific identification rules of medical fault, and further analyzes the existing medical fault type theory and its existing problems, especially on the basis of the typical medical dispute cases, along with the process of medical links. The specific duty of care is to categorization medical malpractice in order to provide useful help for judicial practice and hospital management according to law and improving patient safety.
