体育赛事转播权的著作权问题研究

【摘要】：在2008年北京奥运会后,中国的国际体育地位迅速提升,举办的国际性赛事数量也不断扩大。同时,在与国际接轨后,我国体育赛事的商业化发展也十分迅速,结合国内不断升温的体育热,体育赛事转播权的收益也不断提高。然而,实践中的体育赛事转播权纠纷却始终面临着无法找到法律依据的困境。首先,体育赛事转播权的性质至今仍存在巨大争议,其是否可以被归入我国《著作权法》的保护范围仍然不能确定。此外,随着网络技术日新月异,网络非法转播体育赛事的现象也变得更加频繁,保护防范的难度更是与日俱增。性质界定的困难、法律保护的空白、网络侵权手段的快速发展使我国的体育赛事转播权保护面临着巨大的挑战。本文主要分为四个部分。第一部分中,笔者将会对体育赛事转播权的定义、发展和保护意义作简要阐述。第二部分主要分析了体育赛事转播权的性质。第三部分则是对网络环境下体育赛事转播权的侵权现状进行分析。最后,第四部分中,笔者会对如何在网络环境下保护体育赛事转播权提出相关建议。
[Abstract]:After the 2008 Beijing Olympic Games, China's international sports status has rapidly increased and the number of international events held has been expanding. At the same time, with the international integration, the commercialization of sports events in China is also developing very quickly. Combined with the domestic warming of sports fever, the income of sports event broadcasting rights is also increasing. However, the dispute of broadcasting right of sports events in practice is always facing the dilemma that can not find legal basis. First of all, the nature of the broadcast right of sports events is still controversial, whether it can be classified into the scope of protection of the copyright Law of China is still uncertain. In addition, with the rapid development of network technology, the phenomenon of illegal broadcast of sports events becomes more frequent, and the difficulty of protection and prevention is increasing. The difficulty of defining the nature, the blank of legal protection and the rapid development of network tort means make the protection of broadcasting right of sports events in our country face great challenge. This paper is divided into four parts. In the first part, the author will briefly explain the definition, development and protection significance of sports event broadcasting right. The second part mainly analyzes the nature of broadcasting right of sports events. The third part is to analyze the current situation of sports event broadcasting right infringement under the network environment. Finally, in the fourth part, the author puts forward some suggestions on how to protect the broadcasting rights of sports events in the network environment.
