我国体育赛事新媒体转播权的法律属性及保护研究

【摘要】：本文运用文献资料法、比较研究法、案例分析法和专家访谈法,对我国体育赛事新媒体转播权的权利属性、主体、客体、权利内容、侵权行为以及法律保护现状进行了分析。研究发现:体育赛事新媒体转播存在快速传播、快速更新、内容丰富、信息量大、传播形式多样、接收方式方便、传播无边界限制的优势;也存在侵权严重不易控制、媒体报道缺乏规范的语言、技术发展不成熟、专业技术人才短缺的劣势。体育赛事节目、体育赛事中的表现难美性项目直播权属于作品受著作权法保护。体能主导类、表现准确性及技能对抗性项目直播权受商品化权保护。体育赛事新媒体转播权的权利主体是指拥有使用、许可、收益及禁止权的体育赛事举办方或体育赛事组织者;体育赛事新媒体转播权的客体是指体育组织者或者体育联赛举办的各种体育比赛;体育赛事新媒体转播权的权利内容包括体育赛事信息的发布权宣传权、体育赛事新媒体转播权的市场开发权及禁止权、体育赛事相关数据的获取使用权以及涉及体育赛事的其他权利。体育赛事节目的转播主体是指授权的新媒体机构;体育赛事节目的客体是指新媒体授权转播机构进行的直播、转播、点播的信号;体育赛事节目的权利内容主要包括体育赛事节目的独家直播和转播权、体育赛事转播信号的分销权、体育赛事新闻报道权、体育赛事标志以及无形资产的使用权、体育赛事网络视频广告招商的开发权及收益权、体育赛事信号的复制权及修改权、体育赛事节目转播及点播的禁止权以及与著作权主体相关的其他权利。体育赛事新媒体转播权的侵权行为主要表现在擅自转播比赛视频;非授权网站擅自为公众提供相关赛事的链接和点播服务,博客、播客等个人用户擅自上传赛事信息的行为。相关部门应根据网络侵权种类及性质情节的不同,从协商解决、民事救济、行政救济和刑事救济四个方面对网络版权侵权行为进行救济。我国体育赛事新媒体转播权的立法尚属空白、权利归属尚未明确、权侵权保护机制尚未完善。我国应该尽快健全体育赛事新媒体转播权的法律体系、完善体育赛事新媒体转播权的侵权执法机制、建立体育赛事新媒体转播权的侵权预防机制、规范我国体育赛事新媒体转播权转播合同。
[Abstract]:Using the methods of literature, comparative research, case analysis and expert interview, this paper analyzes the property, subject, object, content, tort and legal protection of the new media broadcasting right of sports events in China. It is found that the new media broadcasting of sports events has the advantages of rapid dissemination, rapid updating, rich content, large amount of information, various forms of communication, convenient receiving methods, and no boundary restrictions; there are also the advantages of serious and difficult control of infringement. Media reports lack of standardized language, technological development is immature, shortage of professional and technical personnel disadvantage. The right to live broadcast in sports events is protected by copyright law. The right of direct broadcast of physical ability, performance accuracy and skills is protected by the right of commercialization. The right subject of the new media broadcasting right of sports events refers to the organizers or organizers of sports events who have the right to use, license, profit and prohibit; The object of new media broadcasting right of sports events refers to various sports competitions organized by sports organizers or sports leagues. The rights of new media broadcasting rights of sports events include the right to publish sports events information and the right to publicize sports events. The rights of market development and prohibition of the rights of broadcasting new media in sports events, the right to obtain the relevant data of sports events and other rights related to sports events. The main body of broadcasting of sports events is the authorized new media organization, the object of sports events is the signal of broadcasting, broadcasting and on demand authorized by new media. The content of the rights of sports events mainly includes the exclusive broadcasting and broadcasting rights of sports events, the distribution rights of broadcast signals of sports events, the right to report news of sports events, the right to use the symbols of sports events and the right to use intangible assets. The rights of exploitation and profit of the network video advertisement of sports events, the rights of reproduction and modification of the signals of sports events, the prohibition of broadcasting and on demand of sports events, and other rights related to the subject of copyright. The infringement of new media broadcasting rights of sports events is mainly manifested in unauthorized broadcasting of game video; unauthorized websites provide the public with the related events of links and on-demand services, blog, podcast and other individual users unauthorized upload event information behavior. According to the different types and nature of network infringement, relevant departments should remedy network copyright infringement from four aspects: negotiation, civil remedy, administrative remedy and criminal remedy. The legislation of new media broadcasting right of sports events in our country is still blank, the ownership of rights is not clear, and the protection mechanism of right infringement is not perfect. Our country should improve the legal system of the new media broadcasting right of sports events as soon as possible, perfect the infringement law enforcement mechanism of the new media broadcasting right of sports events, and establish the infringement prevention mechanism of the new media broadcasting right of sports events. Standardize the contract for broadcasting the new media rights of sports events in China.
