养老机构老人伤害事故责任承担实证研究

【摘要】：随着我国社会老龄化程度的加深,养老已经成为社会公众普遍关注的话题。在人口老龄化和家庭养老功能日渐衰退的双重压力下,入住养老机构成为老年人安度晚年的合适选择。由于相关法律规定的不完善,入住老人受伤后,双方当事人经常为谁承担赔偿责任引发纠纷。这样不仅入住老人的合法权益得不到保障,而且高额频繁的赔偿也使养老机构不堪重负。因此,入住老人在养老机构中出现伤害事故该如何解决、责任该如何划分成了刻不容缓的问题。本文通过实证研究,运用案例分析的方法,按照提出问题、分析问题和解决问题的思路,对养老机构内入住老人伤害事故法律责任承担的问题提出了自己的思考。本文正文共分三个部分：第一部分：提出问题。通过介绍案例说明养老机构中目前存在的问题——入住老人家属与养老机构纠纷多发。第二部分：分析问题。这部分是对“当事人纠纷多发”的原因分析。当事人纠纷不断的实质是养老机构内入住老人伤害事故法律责任认定不清,这一方面是由资金不足、养老机构设备及服务不完善等现实条件所致,另一根本原因是双方当事人的法律关系不明确和双方认定责任依据不清。第三部分：解决问题。对于入住老人伤害事故法律责任承担问题,笔者从法理和现实中来寻求解决的办法,一方面希望有更加合理的归责原则和认定责任主体的方式来指导具体的实践；另一方面从法律法规的制定、养老机构的法律责任承担、入住老人与养老机构格式合同的制定、风险渠道的构建等多个角度来预防及减少入住老人与养老机构的纠纷。总之,本文通过对养老机构内入住老人伤害事故责任承担的案例分析,指出我国养老机构存在的问题,并提出法律责任认定和纠纷缓解的对策,期望本文的研究可以为养老机构的发展提供一个良好的社会氛围,也希望我国的养老服务业可以迈进新阶段。
[Abstract]:With the deepening of the aging of our society, pension has become a common concern of the public. Under the double pressure of aging population and declining family pension function, it is a suitable choice for the elderly to stay in the old age. Due to the imperfections of relevant laws and regulations, after the elderly are injured, the two parties often take the responsibility of compensation and lead to disputes. In this way, the legal rights and interests of the elderly can not be guaranteed, and the high and frequent compensation also makes the pension institutions overburdened. Therefore, the problem of how to solve the injury accident and how to divide the responsibility in the old-age care institution is urgent. Based on the empirical research and case study, this paper puts forward my own thinking on the legal responsibility of the elderly injury accident in the old-age care institutions according to the ideas of putting forward the problems, analyzing the problems and solving the problems. This text is divided into three parts: the first part: put forward the question. Through the introduction of cases to illustrate the existing problems in pension institutions-the elderly family members and pension institutions more disputes. Part two: analysis of problems. This part is an analysis of the causes of the frequent disputes between the parties. The essence of the dispute between the parties is that the legal liability of the elderly injury accident in the pension institutions is not clear, which is caused by the lack of funds, the imperfect equipment and services of the pension institutions, and other practical conditions. Another fundamental reason is that the legal relationship of both parties is unclear and the basis of both parties' determination of responsibility is unclear. The third part: solve the problem. On the one hand, I hope that there are more reasonable principles of imputation and the way to identify the main body of responsibility to guide the specific practice. On the other hand, it can prevent and reduce the disputes between the elderly and the old-age institutions from the formulation of laws and regulations, the legal responsibility of the pension institutions, the establishment of the contract between the elderly and the pension institutions, the construction of risk channels and so on. In a word, this paper points out the problems existing in the old-age care institutions and puts forward the countermeasures of legal liability determination and dispute mitigation through the case analysis on the responsibility of the elderly injury accidents in the pension institutions, and points out the problems existing in the old-age care institutions in our country. It is expected that the research in this paper can provide a good social atmosphere for the development of pension institutions, and also hope that China's pension service industry can enter a new stage.
