《民法总则》“民事权利章”的得与失

【摘要】：民法总则》制定过程中的"通则思维"危害极大,"民事权利章"是其典型表现。在民法典分则会对各项民事权利作详尽规定的预设之下,没有必要再设"民事权利章"。《民法总则》在人格利益保护方面,采行了人格利益保护一般条款加具体人格权之模式,个人信息保护则采行为规制模式,这均应予以肯定。"民事权利章"之中的现有财产权规定应予删除,以免出现财产权规则分置于总则和分则的局面。荣誉权之规定也应当删除。
[Abstract]:In the process of making general principles of civil law, the thought of general principles is extremely harmful, and the chapter of civil rights is its typical manifestation. Under the presupposition that the civil rights will be stipulated in detail in the Civil Code, there is no need to set up a Chapter on Civil Rights. In the protection of the interests of personality, the general principles of the Civil Law adopt the mode of the general provisions of the protection of the interests of personality and the specific personality rights. The personal information protection adopts the behavior regulation pattern, which should be affirmed. " The existing provisions on property rights in the Chapter of Civil Rights should be deleted to avoid the situation that the property rights rules are separated from the general rules and sub-rules. The provision of the right to honour shall also be deleted.
