标准必要专利权利滥用的反垄断规制研究

【摘要】：标准必要专利的产生能够促进创新发展,但也会导致标准阻抑问题和竞争阻碍问题。实践中,标准必要专利的权利滥用行为越来越多,部分甚至严重损害了社会公共利益。虽然民法、专利法和标准化组织专利政策在规制标准必要专利的权利滥用行为上具有一定的作用,但也存在着明显的局限性,使得有效规制的重担落在了反垄断法上。因此,对标准必要专利的权利滥用进行反垄断规制研究具有重要的意义。本研究以上述问题为切入点,旨在分析标准必要专利权利行使中存在的权利滥用行为,并对如何适用反垄断法规制进行探讨。希望在获得分析结果的基础上,提出一些建议完善我国对标准必要专利权利滥用行为的反垄断规制。本文首先概述了研究的背景、目的和意义,以及国内外研究现状;接着对标准必要专利的理论基础进行了介绍,标准必要专利的产生及其影响;然后分析了适用反垄断法规制的必要性及可行性,及如何对标准必要专利的权利滥用行为进行垄断违法性认定;跟着又分析了标准必要专利的一些具体权利滥用行为,在案例分析的基础上给出相应的反垄断规制措施和方法;最后针对我国现状,提出一些建议完善我国对标准必要专利权利滥用的反垄断规制。
[Abstract]:The generation of necessary patent can promote innovation, but also lead to standard inhibition and competition hindrance. In practice, the abuse of standard necessary patent rights is more and more, some even seriously damaged the public interest. Although the civil law, patent law and the patent policy of standardization organization play a certain role in regulating the abuse of rights of standard essential patent, there are also obvious limitations, which makes the burden of effective regulation fall on the anti-monopoly law. Therefore, it is of great significance to study the anti-monopoly regulation of the right abuse of standard essential patents. The purpose of this study is to analyze the abuse of rights in the exercise of standard necessary patent rights, and to discuss how to apply the regulation of antitrust law. On the basis of the analysis results, this paper puts forward some suggestions to improve the antitrust regulation of the abuse of standard necessary patent rights in China. This paper first summarizes the background, purpose and significance of the research, as well as the current research situation at home and abroad, and then introduces the theoretical basis of the standard necessary patent, the emergence and impact of the standard necessary patent. Then it analyzes the necessity and feasibility of the application of anti-monopoly law, and how to determine the monopoly illegality of the abuse of the rights of the standard essential patent, and then analyzes some specific rights abuses of the standard essential patent. On the basis of case analysis, this paper gives the corresponding measures and methods of antitrust regulation. Finally, according to the present situation of our country, some suggestions are put forward to perfect the antitrust regulation of the abuse of standard necessary patent rights in our country.
