公平责任之反思——以羽毛球运动员之间的意外伤害案件为例

【摘要】：通过羽毛球运动员之间意外伤害案件的案例,可以清楚地观察到公平责任在司法实践当中引起的诸多问题。这些问题产生的原因在于我们对其立法目的没有一个清晰、统一的认识。其可能的立法目的包括4种:弥补现有归责原则的不足、"促进社会和谐稳定"、对受害人进行救济、建立新的归责原理。对上述立法目的进行详细分析,可以发现后3种立法目的缺乏正当性。此外,公平责任本身具有很大的体系危害性,加入现有二元归责体系之后,它与过错责任具有不可调和的矛盾。最后,公平责任与体育精神是相悖的,它在体育运动意外伤害案件当中的大量适用会影响体育运动的发展。综上,应当严格限制其适用范围,尤其应当排除其在体育运动意外伤害案件当中的适用。
[Abstract]:Through the case of accidental injury between badminton players, we can clearly observe many problems caused by fair responsibility in judicial practice. The reason for these problems is that we do not have a clear and unified understanding of the legislative purpose. The possible legislative purposes include four kinds: to make up for the deficiency of the existing imputation principle, to "promote social harmony and stability", to provide relief to the victims, and to establish a new imputation principle. Through the detailed analysis of the above legislative purpose, we can find that the latter three legislative purposes lack legitimacy. In addition, fair liability itself has great harm to the system, after joining the existing dual liability system, it has irreconcilable contradiction with fault liability. Finally, fair responsibility is contrary to the spirit of sports, and its application in sports accidental injury cases will affect the development of sports. To sum up, the scope of application should be strictly restricted, especially in sports accidental injury cases.
