好意施惠行为法律问题探究

【摘要】：好意施惠行为在社会生活中是极其常见的,它本身是一种社会层面的行为,虽然它不是法律层面的概念,但在社会生活和司法实践中经常会造成一些让人踌躇的难题,也会引发一些如侵权纠纷这样的进入法律规制范围的问题,实践中亟待通过对它的深入研究以寻找解决具体问题的办法和途径。本文从好意施惠的基础介绍入手,一步步分析好意施惠行为的性质,并对好意施惠造成难题的两种情况分别作了详细分析,细致剖析了好意施惠行为在履行时和履行过程中分别造成纠纷的情况,并对这些纠纷的责任承担等方面进行了较为全面的阐述,致力于在完善好意施惠行为理论体系的同时,找到一种对解决实际问题较为稳妥且稳定的方法,并在文章中提出笔者对于司法实践的一些简单构想和建议,以便可以对社会生活和司法实践提供有力的帮助和支持。
[Abstract]:The act of kindness is very common in social life. It is a kind of social behavior itself. Although it is not a legal concept, it often causes some puzzles in social life and judicial practice. It will also lead to some problems such as tort disputes into the scope of legal regulation. In practice, it is urgent to find ways and means to solve specific problems through in-depth study of them. Starting with the basic introduction of kindness, this paper analyzes the nature of the act of kindness step by step, and makes a detailed analysis of the two kinds of problems caused by kindness. This paper analyzes in detail the situations of disputes caused by well-intentioned acts of favour in the performance and the process of performance, and makes a more comprehensive exposition on the responsibility of these disputes, and devotes itself to perfecting the theoretical system of well-intentioned acts of favour at the same time. To find a more stable and stable method to solve practical problems, and put forward some simple ideas and suggestions on judicial practice in this paper, so as to provide strong help and support for social life and judicial practice.
