德国潘德克吞式《民法总则》之后的人格权法的立法

【摘要】：对人格权法是否独立成编的学术争论应该遵循《民法总则》采用德国潘德克吞体系这一立法技术选择所形成的基本共识。《民法总则》第五章在"民事权利"一章中规定人格权内容并明确了人格权与主体制度分离的立法模式,为人格权法独立成编确立了体系性和类型化的基础。独立成编的侵权责任法以权利救济法的行为规范与裁判法规范的立法定位,无法涵盖人格权法规范的行为规范、裁判规范与赋权规范的内容,由此确定了人格权法独立成编的必然性。《民法总则》有效实现人格权的宪法性权利的民法化、采用民商合一的立法体例对自然人与法人人格权予以分别规定,确定了人格权法独立成编的应然性。基于人格权权利行使与权利保护的立法逻辑,人格权法编的设计,是我国在继承德国潘德克吞体系下民法典总则所作出的必然选择,也是《民法总则》发展德国潘德克吞体系所作出的必然选择。
[Abstract]:The academic debate on whether the personality right law is independent should follow the basic consensus formed by the adoption of the German Pandecton system as a legislative and technical choice. Chapter 5 of the General principles of the Civil Law is in the chapter of "Civil Rights". It defines the content of personality right and clarifies the legislative model of separating personality right from subject system. It establishes the foundation of systematization and typology for the independent compilation of personality right law. The independent tort liability law, which is based on the legislative orientation of the legal norms of the right to remedy and the norms of the adjudication law, cannot cover the content of the norms of conduct of the personality law, the norms of the adjudication and the norms of the empowerment. Therefore, the necessity of the independence of personality right law is determined. The Civil Law General principles effectively realizes the civil law of the constitutional right of personality right, and respectively prescribes the personality right of natural person and legal person by adopting the legislative method of integrating civil and commercial affairs. The character of personality right law is determined. Based on the legislative logic of the exercise and protection of the right of personality, the design of the law of personality right is the inevitable choice made by our country in inheriting the general principles of the civil code under the system of Pandekton, Germany. It is also the inevitable choice of the development of German Pandecton system.
