网络域名抢注的法律规制研究

【摘要】：近几年来,随着计算机技术和电子商务在世界范围内的迅速的发展,作为互联网上的计算机的识别标志,网络域名便有了巨大的商业价值。随之而来的是越来越多的的网络域名抢注活动,使得这类问题显得非常突出,由此一来非常有必要对这种行为进行法律规制。虽然国家颁布相关的法律文件,但是由于网络域名本身的特殊性,在某些方面,比如立法层面,司法管辖,许可注册等方面还是很难充分地保护当事人的合法权益。本文重点研究网络域名抢注的法律规制。通过对网络域名抢注的法律认定的分析,着重研究关于如何有效的规制网络域名抢注以及提出法律设想和建议。论文共分三部分:第一部分,对网络域名抢注的基础技术知识以及网络域名抢注的动因及分类进行了阐述。第二部分,分析了我国网络域名抢注的法律规制现状以及存在的问题。第三部分,针对上述的存在问题提出了相应的解决对策。
[Abstract]:In recent years, with the rapid development of computer technology and electronic commerce in the world, as the identification mark of the computer on the Internet, the domain name of the network has great commercial value. Following this, more and more online domain name grabbing activities make this kind of problem appear very prominent, so it is very necessary to regulate this kind of behavior. Although the country promulgates the related legal documents, due to the particularity of the network domain name itself, it is difficult to fully protect the legitimate rights and interests of the parties in some aspects, such as legislative level, jurisdiction, license registration and so on. This paper focuses on the legal regulation of domain name grabbing. Through the analysis of the legal cognizance of the online domain name preemption, this paper focuses on how to regulate the online domain name preemption effectively, and puts forward some legal ideas and suggestions. The paper is divided into three parts: the first part, the basic technical knowledge of domain name grabbing, the motivation and classification of domain name grabbing. The second part analyzes the current situation and existing problems of the legal regulation of domain name grabbing in China. In the third part, the author puts forward the corresponding solutions to the above problems.
