单位主体制裁体系的碎片化缺陷及其修复

【摘要】：单位作为参与社会、经济活动的重要主体,对其规制的制裁正义也尤为重要。我国法律格局经历了诸法合体到部门法分立,形成了对单位违法犯罪行为的民事法、行政法、刑事法三部门的制裁体系。然而,这种部门化制裁在立法上和司法实践中却存在着制裁外溢与法律属性的矛盾、严厉性与法律效果的失衡、制裁竞合与法律适用的混乱、认定标准与法律救济的失当等碎片化问题。从顺应公法与私法分立下融合的趋势出发,妥当把握私法公法化与公法私法化的限度,我国单位主体制裁碎片化修复的具体路径可以从建构一体化的单位主体制裁体系、明确单位主体制裁在不同程序中的竞合适用、提升单位主体制裁的认定标准、促进单位主体制裁与非制裁性法律责任的联动等方面着手。
[Abstract]:As an important subject of participating in social and economic activities, it is particularly important for the unit to regulate the sanction justice. The legal pattern of our country has experienced the combination of various laws into the division of law, and has formed the sanction system of three departments, namely, civil law, administrative law and criminal law. However, in legislation and judicial practice, however, there are contradictions between sanctions spillover and legal attributes, imbalance between severity and legal effect, confusion between competition of sanctions and application of law. The identification of standards and legal remedies and other fragmented issues. In order to conform to the trend of amalgamation under the separation of public law and private law, and properly grasp the limitation of private law and private law, the specific path to repair the fragmentation of unit subject sanctions in our country can construct an integrated unit subject sanction system. It is clear that the unit subject sanctions should be applied in different procedures, the identification standard of unit subject sanctions should be promoted, and the linkage between unit subject sanctions and non-sanction legal liability should be promoted.
