公法视野下的不动产登记法律制度研究

【摘要】:不动产登记制度即是国家调控功能的转变的重要标制,又是物权变动的公示手段。只有挖掘出登记行为最核心的价值和功能和目标,才能保证登记行为中权力和权利关系的平衡,保证市场经济的稳定发展,保证不动产登记中的私权保护优先原则。目前来看,我国的不动产登记制度还有很多理论漏洞急需填补,制度设计不够精细,缺乏可操作性,我们在研究不动产登记制度中,私法领域的制度设计已经非常细致,而不动产登记的公法研究还略显粗陋。登记制度要能得以完善,还需要进一步细化现有的理论研究。其中有二点需要注意:1,在研究不动产登记制度时需要有一个宏观的视野,从各部门法中的登记制度挖据出背后的法理依据,还要看到部门法学间的联系,特别是部门法之间的共性因子。不动产登记并非单纯的民事法律制度,还需要从公法视角对不动产登记进行法律制度的研究和保护。2,我们在借鉴外国不动产登记的经验中,需要运用价值判断标准,着眼于现实生活中的利益冲突,弥补我国登记制度的不足,制定出符合我国国情的法律。最后,立法的目的是为了使文字中的法律变成行动中的法律,要让法律的实施效果不会偏离立法预期,则需要相应的制度建设进行配合,进一步的制度改良则是程序正义的重要保证。本文试图以公法视角对不动产登记法律制度的性质,内涵,价值,审查方式等进行全面分析。内容涉及不动产登记的基础理论,不动产登记的法律意义,国内外不动产登记制度的比较,不动产登记制度的完善等内容。
[Abstract]:The registration system of real estate is not only an important standard system for the change of state regulation function, but also a public means of real right change. Only by digging out the most core value, function and goal of registration behavior can the balance between power and right be guaranteed, the stable development of market economy and the principle of private right protection in registration of real estate can be ensured. At present, there are still many theoretical gaps in the real estate registration system in our country that need to be filled. The system design is not precise enough and lacks operability. In our research on the real estate registration system, the system design in the field of private law has been very careful. And the public law research of real estate registration is still a bit crude. In order to perfect the registration system, it is necessary to further refine the existing theoretical research. Two of them need to pay attention to: 1. When studying the real estate registration system, we need to have a macroscopic view, dig out the legal basis behind the registration system in various departments and laws, and also see the links between the law departments. In particular, the common factors between department law. Real estate registration is not only a civil legal system, but also needs to study and protect the legal system of real estate registration from the perspective of public law. In drawing lessons from the experience of foreign real estate registration, we need to use the value judgment standard. Focusing on the conflict of interest in real life, to make up for the deficiency of the registration system in our country, to make up the law which is in accordance with the national conditions of our country. Finally, the purpose of the legislation is to make the law in the text become the law in action. In order to ensure that the implementation effect of the law does not deviate from the expectation of the legislation, the corresponding system construction is needed. Further institutional improvement is an important guarantee of procedural justice. This paper attempts to analyze the nature, connotation, value and examination of the legal system of real estate registration from the perspective of public law. The content involves the basic theory of real estate registration, the legal significance of real estate registration, the comparison of real estate registration system at home and abroad, the perfection of real estate registration system, etc.
