“街区制”模式下小区道路公共化的法律规制

【摘要】："街区制"住宅政策的推行,是我国城市规划理念革新的产物,其有利于优化城市路网布局,促进土地资源有效利用,满足我国城市化发展的新需求。但是,"街区制"住宅政策与我国现有的法律制度相抵牾,必将造成小区内道路私人利用与公共利用的紧张与矛盾。国家对住宅小区内道路使用权的限制,应属于法律上的准征收,因此,要求法律对其予以规制,包括合理界定公共利益范围、制定正当的准征收程序,确定公平的补偿标准等等,唯有如此,方能有效实现私权与公权之间的利益平衡。
[Abstract]:The implementation of "block system" housing policy is the product of innovation of urban planning concept in China. It is beneficial to optimize the layout of urban road network, promote the effective use of land resources and meet the new needs of urbanization development in China. However, the contradiction between the housing policy of "block system" and the existing legal system of our country will inevitably lead to tension and contradiction between private and public use of roads in residential areas. The restriction of the right to use the road in the residential district by the state should belong to the legal quasi-expropriation. Therefore, the law is required to regulate it, including the reasonable definition of the scope of public interest, the establishment of a proper quasi-expropriation procedure, Only in this way can the balance of interests between private right and public right be effectively realized.
