转基因食品的消费者知情权研究

【摘要】：转基因食品作为新的食品类别正逐步渗透人们的日常生活。由于转基因食品涉及较为复杂的科学技术内容,而且长期以来国内外对其安全性一直存在争议,导致消费者对转基因食品存在质疑。虽然,消费者知情权是《中华人民共和国消费者权益保护法》赋予消费者的基础权利,但是我国法律对于转基因食品的消费者知情权并未作出详细的说明,因此在转基因食品领域的消费者知情权的还未得到充分的保障。本文在分析消费者知情权及其性质、回顾国内外转基因食品管理制度以及与转基因食品知情权相关的法律规定的基础上,指出我国转基因食品消费者知情权保护上,存在转基因作物审批阶段信息不公开不透明,在转基因食品标签方面存在标签要求不具体、未依法落实等问题。并由此提出转基因食品审批阶段信息加大信息公开,消费阶段确保强制标签制度的落实,以及完善转基因食品上市后的消费者监督和信息公开制度等建议。希望为转基因食品领域的消费者知情权的保护提供有益的参考。
[Abstract]:As a new food category, GM food is gradually infiltrating people's daily life. Because GM food involves more complicated scientific and technological content, and its safety has been controversial for a long time at home and abroad, leading to consumers have doubts about GM food. Although the right of consumers to know is the basic right given to consumers by the Law of the people's Republic of China on the Protection of Consumer Rights and interests, the right to know of the consumers of genetically modified foods has not been explained in detail in the laws of our country. Therefore, the right to know in the field of GM food has not been fully protected. On the basis of analyzing the consumers' right to know and their properties, reviewing the management system of genetically modified food at home and abroad and the legal provisions related to the right to know about genetically modified food, this paper points out that the protection of the right to know of the consumers of genetically modified food in China. There are some problems such as the information of the approval stage of transgenic crops is not open and opaque, the labelling requirements of transgenic foods are not specific, and they are not implemented according to law. It also puts forward some suggestions such as increasing the information disclosure in the approval stage of genetically modified food, ensuring the implementation of the mandatory labelling system in the consumption stage, and perfecting the consumer supervision and information disclosure system after the GM food is listed. It is hoped to provide a useful reference for the protection of consumers' right to know in the field of genetically modified food.
