我国社会中介组织法律规制研究

【摘要】:社会中介组织作为连接国家、市场的第三部门在中国得到迅猛发展,承担了许多由政府分离出来的公共管理职能,然而,在转型时期的中国,社会中介组织发展不均衡、与政府藕断丝连、法律地位模糊、责任难以确定,已经严重的制约了社会中介组织本身的发展和政府机构的改革;在传统行政法中社会中介组织仅仅作为法律法规授权或委托的组织的定位,存在着授权不清、责任不明、难以诉讼的弊端,根据公共行政的治理理论,社会中介组织的权力来源是行政分权,同时也是法律的规定,因而建议我国借鉴大陆法系的公法人制度,将社会中介组织作为公法人的—种纳入行政法的调整,使社会中介组织成为行政主体,当社会中介组织行使公权力对其相对人或其组织成员的权利造成侵害时,对社会中介组织提起行政诉讼是最后也是最有效的手段;通过行政分权,社会中介组织拥有了公共管理权,但是,公共权力有扩张和滥用的可能,所以要对社会中介组织进行法律规制,建议制定社会中介组织法对社会中介组织的设立条件、法律地位、权利义务和责任作出相应的规定,使社会中介组织在法治的轨道内健康发展。
[Abstract]:Social intermediary organizations as a link to the country, the third sector of the market in China has been rapid development, has assumed a lot of public management functions separated from the government, however, in the transition period of China. The development of social intermediary organizations is not balanced, and they are connected with the government, the legal status is vague, and the responsibility is difficult to determine, which has seriously restricted the development of social intermediary organizations and the reform of government institutions. In the traditional administrative law, social intermediary organizations are only authorized or entrusted by laws and regulations. There are some disadvantages such as unclear authorization, unclear responsibility and difficulty in litigation, according to the governance theory of public administration. The source of power of social intermediary organizations is administrative decentralization and also the regulation of law. Therefore, it is suggested that our country should draw lessons from the public legal person system of civil law system and bring social intermediary organizations as public legal persons into the adjustment of administrative law. Make the social intermediary organization become the administrative subject, when the social intermediary organization exercises the public power to its opposite party or its organization member's right to cause the infringement. Administrative litigation against social intermediary organizations is the last and most effective means; Through administrative decentralization, social intermediary organizations have the right of public management, but public power has the possibility of expansion and abuse, so it is necessary to regulate the social intermediary organizations by law. It is suggested that the establishment conditions, legal status, rights, obligations and responsibilities of social intermediary organizations should be formulated in order to make the social intermediary organizations develop healthily in the orbit of ruling by law.
