广州市质量技术监督管理行政执法存在问题及对策研究

【摘要】：改革开放以来，我国经济正处在高速发展，质量问题已经不仅是经济发展中的一个战略问题，而且关系着人民群众的切身利益，关系企业的生存和发展，关系国家形象和整个经济社会的健康发展，更是关系社会和谐稳定的政治问题。在我国保障民生、构建社会主义和谐社会的大背景下，质量尤其重要，无论是消费的增长，还是企业的发展都离不开质量的支撑，想提高人民群众的生活水平更是应该让其对市场上产品的质量放心，对生活安全放心。在我国，近年来产品安全事件频发，成为各大媒体的头版头条，产品质量安全问题日益突出，社会关注度空前高涨。这使与产品安全相关联的质监部门，更被社会舆论推到风口浪尖上，特别是基层质监部门，导致民众对国产产品失去信心的同时，也对质监部门行使职权有了一定的质疑。因此对广州市质监部门当前执法状况的研究，提出存在的问题和分析原因，从政府公共管理的角度，探索提高质量技术监督部门整体执法水平的对策，对提高广州市质监行政执法水平、更好地促进广州市经济又好又快发展、保障人民群众生命财产安全有着重要的现实意义。本文从当前广州市质监局行政执法的现状入手，以服务型政府和依法行政理论为指导，提出了广州质监行政执法存在问题，主要包括执法力量和行政效率不高，执法缺位与部门冲突，考核和检验不合理，执法难度大，强制措施不合理。并对这些问题进行了进行了原因分析，主要分析了6个方面的原因：行政设置需要改进，执法队伍综合优势不足，法律规定的部分情况操作性不强，内部考核机制不合理，执法环境未优化，检验机制不合理。在此基础上，，最后从提高行政执法队伍素质、强化培训、充实装备和提高待遇、改革考核方式、发挥社会力量、部门和谐执法、提高宣传力度七个方面提出提高广州质监局行政执法能力的对策，从而改善质监部门的形象，指导执法人员不断提高自身执法水平和服务质量，进一步提高质量技监部门执法水平和管理工作的有效性。
[Abstract]:Since the reform and opening up, China's economy is developing at a high speed. The problem of quality is not only a strategic issue in economic development, but also relates to the vital interests of the people and the survival and development of enterprises. Concerning the image of the country and the healthy development of the whole economy and society, it is also a political issue related to the harmony and stability of the society. Under the background of safeguarding the people's livelihood and building a harmonious socialist society in our country, quality is especially important, whether it is the growth of consumption, The development of enterprises can not be separated from the support of quality. To improve the living standards of the people, it is necessary to rest assured of the quality of products on the market and the safety of life. In China, product safety incidents have frequently occurred in recent years, making them headlines in various major media. The problem of product quality and safety has become increasingly prominent and the social concern has never been higher. This has led to quality supervision departments associated with product safety. It has been pushed to the forefront by public opinion, especially the quality supervision departments at the grass-roots level, which has led the public to lose confidence in domestic products at the same time. It also has certain doubts about the exercise of the authority of the quality supervision department. Therefore, the study on the current law enforcement situation of the quality supervision department in Guangzhou puts forward the existing problems and analyzes the reasons, from the angle of the government's public administration. It is of great practical significance to explore the countermeasures to improve the law enforcement level of quality and technical supervision department in Guangzhou, to improve the administrative law enforcement level of quality supervision in Guangzhou, to better promote the sound and rapid development of Guangzhou's economy, and to ensure the safety of people's lives and property. Based on the current situation of Guangzhou quality Supervision Bureau, and guided by the service-oriented government and the theory of administration according to law, this paper puts forward the existing problems of Guangzhou quality Supervision Administrative Law Enforcement, including the law enforcement power and the low administrative efficiency. The absence of law enforcement is in conflict with the department, the examination and inspection are unreasonable, the enforcement of the law is difficult, the compulsory measures are unreasonable. The causes of these problems are analyzed, and the main reasons are analyzed in six aspects: the administrative setup needs to be improved, The comprehensive advantages of the law enforcement team are insufficient, some of the situations stipulated by the law are not operable, the internal examination mechanism is unreasonable, the law enforcement environment is not optimized, and the inspection mechanism is unreasonable. On this basis, finally, from improving the quality of the administrative law enforcement team and strengthening the training, Seven aspects, including enriching equipment and improving treatment, reforming examination methods, giving play to social forces, enforcing the law harmoniously by departments, and enhancing publicity, seven aspects are put forward to improve the administrative law enforcement capacity of the Guangzhou quality Supervision Bureau, thereby improving the image of the quality supervision department. Guide the law enforcement personnel to improve their own law enforcement level and service quality, and further improve the effectiveness of the law enforcement and management work of the quality technical supervision department.
