基于专利分散理论的我国半导体照明专利研究

【摘要】:半导体照明是现在最先进的照明技术,半导体照明产业的国际竞争非常激烈,随着我国半导体照明产业的不断发展,近几年来,相关专利量和权利人数量不断增加,国外企业为了争夺我国半导体照明市场不断的申请专利,这些专利所涉及的技术领域范围不断扩大,这样一来出现了许多问题,例如某些创新型产品:半导体,计算机软件,电子技术等,这些产业的专利分别由不同的专利权人所拥有,导致了专利权的“分散”。为了实现某一项产品的生产,需要通过多个权利人的许可,就像通过森林一样要披荆斩棘,才能走出森林。为此企业要付出高额的许可费用,从而阻碍了技术创新。我国半导体照明产业会不会出现专利分散问题? 本文通过分形理论等方法验证我国半导体照明产业是否存在专利分散现象,实证研究了影响专利分散的因素和专利分散造成的影响,结合国内外应对专利分散的策略,构建了博弈模型比较分析了三种专利战略的市场绩效。本文的创新点主要有以下几点: 首先,对专利分散做出界定,综合国内外的参考文献,比较了国外学者对专利分散的不同看法,从中归纳总结出了对于专利分散的界定,在提出专利分散假设的基础上通过构造博弈模型发现在企业从对新技术的研发到申请专利整个过程中,采取缩短研发周期,存在阻碍性专利这些因素都会促进企业专利的分散;企业为了生产出产品必须获得权利人的专利许可,如果许可人越多,企业的经济利润越低消费者剩余越低,对于整个社会福利越不利; 其次,本文分析总结了国内外有关测量专利分散方法,提出了利用分形理论等方法测量专利分散程度,并且以我国半导体照明产业为例来验证专利分散现象以及实证研究了影响我国半导体照明产业专利分散的因素和专利分散产生的影响,发现技术标准,专利权人数,合作专利数量等因素会影响专利分散,专利分散会造成专利权过度扩散侵犯到公共领域等不利结果; 最后,本文总结分析了国外应对专利分散的措施,比较分析了专利许可,专利池,专利集中战略三种不同的专利战略的优劣势,提出了适合我国半导体照明产业发展的解决专利分散问题的应对建议。
[Abstract]:Semiconductor lighting is the most advanced lighting technology at present. The international competition in semiconductor lighting industry is very fierce. With the continuous development of semiconductor lighting industry in China, in recent years, the number of relevant patents and rights holders has been increasing. In order to compete for the patent of semiconductor lighting market in our country, foreign enterprises have been applying for patent, and the scope of technical fields involved in these patents has been expanding constantly. As a result, many problems have arisen, such as some innovative products: semiconductors, computer software, Electronic technology, the patents of these industries by different patentees, leading to the patent "dispersion." In order to realize the production of a certain product, it needs the permission of multiple right holders, just like through the forest, to get out of the forest. To this end, enterprises have to pay high licensing fees, thus hindering technological innovation. Will there be patent dispersion in semiconductor lighting industry in China? This paper verifies whether patent dispersion exists in semiconductor lighting industry by means of fractal theory, studies the factors influencing patent dispersion and the influence of patent dispersion, and combines the strategies to deal with patent dispersion at home and abroad. A game model is constructed to compare and analyze the market performance of three patent strategies. The main innovations of this paper are as follows: firstly, it defines patent dispersion, synthesizes the references at home and abroad, compares the different views of foreign scholars on patent dispersion, and summarizes the definition of patent dispersion. On the basis of putting forward the hypothesis of patent dispersion, it is found by constructing game model that in the whole process from the research and development of new technology to the application for patent, shortening the period of research and development and the existence of obstructive patent will promote the dispersion of enterprise patent. In order to produce the product, the enterprise must obtain the patent license of the right holder. If there are more licensees, the lower the economic profit of the enterprise, the lower the consumer surplus, which is more disadvantageous to the whole social welfare. Secondly, this paper analyzes and summarizes the methods of patent dispersion at home and abroad, and proposes to use fractal theory and other methods to measure the degree of patent dispersion. And taking the semiconductor lighting industry in China as an example to verify the phenomenon of patent dispersion and empirical study of the factors that affect the patent dispersion and the impact of patent dispersion in the semiconductor lighting industry in China, the technical standards of discovery, the number of patents, The number of cooperative patents and other factors will affect the dispersion of patents, patent dispersion will lead to the excessive spread of patent rights into the public domain and other adverse results; Finally, this paper summarizes and analyzes the foreign measures to deal with patent dispersion, and compares the advantages and disadvantages of three different patent strategies: patent license, patent pool and patent centralized strategy. Some suggestions are put forward to solve the problem of patent dispersion suitable for the development of semiconductor lighting industry in China.
