法律职业资格考试制度研究

【摘要】：法律职业资格考试制度改革作为司法体制改革的重要一环,受到司法实物界和学术界的关注。法律职业资格考试制度取代司法考试制度是一种遴选法律人才的方式的改变。法律职业资格的取得条件以及考试的范围和职业准入条件将会有所改进以适应社会发展的需要。笔者将会介绍其他国家的法律职业资格考试制度,并从其中吸收先进的经验供我国现今司法考试制度改革借鉴。目前现行司法考试制度运作方式存在缺陷、司法考试内容不科学等问题,提出笔者的改革意见。第一部分介绍了其他国家的法律职业资格考试制度,为我国司法考试制度的改革提供参照和经验,不至于我国的法律职业资格考试制度改革走更多的弯路,达到中学为体,西学为用的效果,建立一个符合我国国情的关于法律职业资格考试的制度。文中还对我国司法考试制度的演变进行简单介绍。第二部分主要介绍了我国现行司法考试制度实施15年来,司法考试制度面临的考试制度的管理、考试模式、报名条件、运行机制以及与相关法律制度的衔接等问题。第三部分针对统一司法考试制度之后面临的问题,提出自己的改革建议。其中包括加强立法,完善考试管理制度;建立科学合理的考试模式;报名条件的调整;做好考试制度与相关制度的衔接工作。
[Abstract]:As an important part of the reform of the judicial system, the reform of the examination system of the legal profession qualification has been concerned by the judicial material circles and the academic circles. The legal qualification examination system replaces the judicial examination system is a way to select legal talents. The conditions of obtaining legal professional qualifications, the scope of examination and the conditions of professional access will be improved to meet the needs of social development. The author will introduce the legal qualification examination system of other countries and absorb advanced experience from it for reference in the reform of our country's current judicial examination system. At present, there are some defects in the current judicial examination system, such as the unscientific content of the judicial examination, and the author's reform suggestions are put forward. The first part introduces the legal professional qualification examination system of other countries, which provides reference and experience for the reform of the judicial examination system in our country, so as not to take more detours in the reform of the legal professional qualification examination system in our country, so as to reach the body of the middle school. The effect of western learning is to establish a legal qualification examination system in accordance with the national conditions of our country. The article also briefly introduces the evolution of our country's judicial examination system. The second part mainly introduces the management, examination mode, registration condition, operation mechanism and the connection with the relevant legal system of the judicial examination system in the past 15 years. In the third part, the author puts forward his own reform suggestions in view of the problems after the unification of the judicial examination system. It includes strengthening legislation, perfecting examination management system, establishing scientific and reasonable examination mode, adjusting registration conditions, and doing well the linking work between examination system and related system.
