大学更名引发的冲突与化解——以新泽西学院为例

【摘要】:大学更名是世界高等教育发展史上普遍的现象。20世纪90年代中期,为吸引和招收更大范围的优质生源,美国特伦顿州立学院更名为新泽西学院。这一行为遭到了校内外诸多利益相关者的反对,并引发了与普林斯顿大学的校名所有权之争。为夺回校名所有权,普林斯顿大学采取了申请专利保护、法律诉讼等手段,最终双方以庭外和解的方式化解了冲突。新泽西学院更名事件,对我国高等教育发展具有几点启示:一是理性看待更名,支持大学谋划发展;二是加强协商沟通,和平合理解决冲突;三是建立完善大学章程,有效防止校名被侵占;四是正确引导舆论,避免事件恶化升级。
[Abstract]:University renaming is a common phenomenon in the history of higher education in the world. In the middle of 90s, in order to attract and recruit a larger range of high-quality students, Trenton State College was renamed New Jersey College. This action has been opposed by many stakeholders both inside and outside the university, and has led to a dispute over the ownership of the name of Princeton University. Princeton University applied for patent protection, legal proceedings and other means, finally the two sides resolved the conflict by settling the conflict out of court. The New Jersey College name change incident has several implications for the development of higher education in China: first, the rational view of the change of name. To support the planning and development of universities; second, to strengthen consultation and communication, and to resolve conflicts peacefully and rationally; third, to establish and improve the university charter to effectively prevent school names from being encroached on; and fourth, to correctly guide public opinion and avoid the escalation of incidents.
