【摘要】:教育公平问题是一个老生常谈的问题,也是当下的一个热点问题,就现实所发生的关于教育公平的种种事件来讲,我国公民公平受教育权并没有得到有效的保障。笔者写作此篇论文的目的在于研究我国相关教育公平的现状,分析产生这些现状的原因,并给出自己的见解和解决问题的一些措施。本文参考古今中外对公平和教育公平理念的不断发展成果,对公平的产生、发展及其所蕴含的理论内容有所阐述,对教育公平的含义、内在的规定性、基本特征、本身所蕴含的意义等进行了阐述,并立足宪法的视角,阐述了教育公平的宪法依据以及在宪法领域的相关探讨,使教育公平从理论向现实贴近;通过对美国、日本、巴西等国家在教育公平方面的现状研究,相对于我国的教育公平现状,借鉴这些国家的成功经验,找出对我国教育公平发展的重大启示;对我国当前教育不公平现状的分析研究,得出我国教育不公平主要表现在教育机会的不公平、教育过程的不公平和教育结果的不公平,并找出造成我国教育不公平的主要原因所在,教育资源的不合理配置、对于弱势群体和特殊群体的忽视、面对新的状况立法和制度的建设不足等原因;对于我国教育不公平的问题,本文给出了相应的办法,首先在法律层面,建立健全促进教育公平的法律法规,明确教育公平为法定权利,从法律上明确政府在公民受教育公平中的责任,健全保障特殊群体公平受教育的权利的法律法规;其次,利用司法保障教育公平,通过普通法层面和宪法层面的法律救济保障公民的公平受教育权利;最后严格执法保障教育公平,有了法律法规的保障,那么严格的执法就是教育公平实现的关键;除了上面的措施以外,本文提出了其他的一些措施,比如农民工子女稳定受教育机制、努力发展各级各类教育事业,不断扩大人民群众接受教育的机会等措施。 教育公平的落实是一项复杂而又具体的工程,,需要长期的努力,需要国家各个方面的协调配合,但是笔者认为只有从法律上确立公民公平受教育的权利,从法律上给与教育公平的保障,教育公平才能有切实的起点和依据,因此法律层面的教育公平保障才是其他相关机制的基础所在,所以建立全面的教育公平法律法规是重中之重。
[Abstract]:The issue of educational fairness is a clich 茅, but also a hot issue at present, in terms of the reality of the occurrence of a variety of events on education equity. The purpose of this thesis is to study the current situation of educational fairness in China and analyze the reasons for the present situation. The author also gives his own opinions and some measures to solve the problem. This article refers to the continuous development of the concept of equity and educational equity, and expounds the emergence, development and the theoretical content of equity. This paper expounds the meaning, internal regulation, basic characteristics and the meaning contained in education fairness, and expounds the constitutional basis of education fairness and its related discussion in the constitutional field based on the perspective of the constitution. To make education fair from theory to reality; Through the research on the present situation of the United States, Japan, Brazil and other countries in the field of educational equity, compared with the present situation of our country's educational equity, the author draws lessons from the successful experiences of these countries and finds out the great enlightenment to the development of our country's educational equity. Based on the analysis of the current situation of educational injustice in China, it is concluded that the unfair educational opportunity, the unfair process of education and the unfair result of education are the main manifestations of the unfairness of education in our country. And find out the main reasons of the education unfairness in our country, the unreasonable allocation of educational resources, the neglect of the vulnerable groups and special groups, and the insufficient construction of legislation and system in the face of the new situation. As to the problem of education unfairness in our country, this paper gives the corresponding methods. Firstly, at the legal level, we should establish and perfect the laws and regulations to promote the education fairness, and make clear that the education fairness is the legal right. From the legal point of view, it is clear that the government is responsible for the fair education of the citizens, and the laws and regulations that guarantee the right of the special groups to receive education fairly are improved. Secondly, the use of judicial protection of education fairness, through the common law level and constitutional level of legal relief to protect citizens' right to fair education; Finally, strict enforcement of law to ensure education fairness, with the protection of laws and regulations, so strict law enforcement is the key to the realization of education equity; In addition to the above measures, this paper puts forward some other measures, such as stable education mechanism for the children of migrant workers, and strive to develop all kinds of educational undertakings at all levels. Continue to expand the people's access to education and other measures. The implementation of education equity is a complex and concrete project, which needs long-term efforts, the coordination of all aspects of the country, but the author believes that only from the law to establish the right of citizens to a fair education. From the legal protection of education equity, education equity can have a real starting point and basis, so the legal level of education equity protection is the basis of other relevant mechanisms. Therefore, the establishment of comprehensive education fair laws and regulations is the most important.
