占里习惯法的传承方式及其教育内涵分析

【摘要】: 习惯法在当今少数民族地区仍然发挥着调节社会秩序的重要作用。其顺利传承对于维护少数民族社会的生产与生活秩序、规范少数民族地区的人们的社会行为等都有着非常大的影响。在现代文化的有力冲击下,习惯法的传承方式直接关系着习惯法文化的顺利传承,也间接关系着少数民族传统社会结构与社会秩序的稳定。 占里的习惯法独具特色,其传统性与独特性为人们所惊叹。这也是论文选取占里习惯法的传承方式为研究对象的主要原因。本论文在分析田野调查以及文献查阅所取得的资料的基础上,以一种整体的视角,分析了处于占里独特的文化生态环境中的习惯法的传承方式。分析表明,集体活动传承、家庭传承以及静物的传承是占里习惯法三种核心的传承方式。在总结占里习惯法的传承方式的基础上,,文章分析了占里习惯法传承的教育内涵,指出占里习惯法的传承是一种与占里特有的文化生态环境相互动的特殊教育,这种教育的出发点是集体的需要而非个体发展的需要。此外,在占里习惯法多样化的传承方式中也蕴含着丰富的教育经验,比如,综合运用多种教育方式;以思想意识的控制为主导;集体主义;以得到受教育者的接受和认同为教育前提等。在这些教育经验中也有一些经验是不值得借鉴的,比如以鬼神观念相结合的神秘主义的思想控制。
[Abstract]:Customary law still plays an important role in regulating the social order in minority areas today. Standardizing the social behavior of people in minority areas has a great influence. Under the powerful impact of modern culture, the way of inheritance of customary law is directly related to the smooth transmission of customary law culture. It is also indirectly related to the stability of the traditional social structure and social order of ethnic minorities. Zhanli's customary law is unique, This is the main reason why this paper chooses the inheritance of customary law of Zhanli as the object of study. Based on the analysis of the data obtained from field investigation and literature review, From a holistic perspective, this paper analyzes the mode of inheritance of customary law in Zhanli's unique cultural and ecological environment. The analysis shows that the inheritance of collective activities, Family inheritance and still life inheritance are three core ways of inheritance of Zhanli customary law. On the basis of summing up the inheritance of Zhanli customary law, the article analyzes the educational connotation of Zhanli customary law inheritance. It is pointed out that the inheritance of customary law in Zhanli is a kind of special education that interacts with Zhanli's unique cultural and ecological environment. The starting point of this kind of education is the needs of the collective rather than the needs of individual development. There are also rich educational experiences in the diverse ways of inheritance of Zhanli customary law, such as the comprehensive use of various educational methods, the control of ideology, collectivism and collectivism. Some of these educational experiences are not worth learning from, for example, the idea of mysticism combined with the idea of ghosts and gods.
