“行政的归行政,民事的归民事”——与《论契约在远程教育的引入》作者商榷

【摘要】:教育关系总体来看包含具有纵向隶属性的教育行政关系和具有横向平等性的教育合同关系,问题的关键在于这两种关系在教育制度的整体中各占多大的比例,哪种关系处于主要地位从根本上决定了教育关系的性质。本文从我国教育制度实践中的招生模式入手,分析招生的两个模式都具有接受政府主管部门严格管理的行政色彩,说明教育关系是一种行政性关系。契约关系是平等主体之间的协商关系,契约关系在教育关系中不占主导地位。远程教育固然有其特点,但并不违背我国现存教育关系行政性的共性本质。行政问题的处理不能用民事诉讼的方法,只有对于远程教育法律关系正确判断才能正确解决远程教育过程中出现的诸多法律问题。
[Abstract]:Generally speaking, the educational relationship includes the educational administrative relationship with vertical membership and the education contract relationship with horizontal equality. The key problem lies in the proportion of the two relationships in the whole education system. Which relationship is in the main position fundamentally determines the nature of the educational relationship. This article starts with the enrollment mode in the practice of our country's educational system, and analyzes that the two models of enrollment both have the administrative color of accepting the strict management of the government department in charge, which shows that the educational relationship is an administrative relationship. The contractual relationship is the negotiation relationship between the equal subjects, and the contractual relationship does not occupy the leading position in the educational relationship. Although distance education has its own characteristics, it does not violate the common essence of the administrative nature of the existing educational relations in China. Administrative problems can not be handled by civil litigation. Only by correctly judging the legal relationship of distance education can we correctly solve many legal problems in the process of distance education.
