我国大学章程制定的理论、实践与现实路径

【摘要】：大学章程是依法治教的重要组成部分，是现代大学制度建设的重要内涵。成熟的法治国家，需要有“上承国家教育法律法规、下启学校规章制度”的大学章程来规范学校的办学行为，界定学校的运行机制。因此，章程被称为大学发展、建设与管理的“宪法”。当前我国部分高校正在开展制定章程的试点工作，同时，教育部公布了《高等学校章程制定暂行办法》，要求全国高校陆续制定出台大学章程。但是，，我们在大学章程的理论和实践上还缺乏系统的研究，在操作层面的政策上更缺乏规范性的指导意见。本文通过界定大学章程的定义，揭示了我国大学章程的发展历程和作用，进一步讨论了我国大学章程制定实施过程中关于解决好内外部关系、章程制定主体、制定程序、修改程序和大学章程的基本内容框架等理论问题，分析了当前大学章程制定实施的现状和存在的问题，探索提出了当前我国大学章程制定实施的现实选择：第一，全方位提升认识是大学章程科学制定实施的前提保障。第二，深化教育管理体制改革是大学章程制定实施的必要条件。第三，政府参与大学章程制定是保证大学章程法律和效力的核心。第四，学术权力“复位”是大学章程得以有效实施的核心要求。第五，建立健全大学章程的配套机制和措施是大学章程有效实施的后续保证。同时，尝试性地提出了适合我国实际情况的大学章程基本模式。
[Abstract]:The constitution of university is an important part of managing education according to law and the important connotation of the construction of modern university system. In a mature country ruled by law, it is necessary to have the university articles of association which "accept the national education laws and regulations, and the rules and regulations of the lower school" to standardize the school running behavior and define the operating mechanism of the school. Therefore, the constitution is called the "Constitution" of university development, construction and management. At present, some colleges and universities in our country are carrying out the pilot work of making articles of association. At the same time, the Ministry of Education has published the interim measures for the formulation of the articles of Association of Colleges and Universities. However, there is a lack of systematic research on the theory and practice of the university charter, and a lack of normative guidance on the operational policy. By defining the definition of the university charter, this paper reveals the development course and function of the university charter in China, and further discusses how to solve the internal and external relations, the main body and the procedure of the constitution formulation in the process of making and implementing the university charter in our country. This paper analyzes the current situation and existing problems of the establishment and implementation of the university charter, and probes into the practical options for the establishment and implementation of the university charter in our country: first, All-round promotion of understanding is the prerequisite for the scientific formulation and implementation of the university charter. Second, deepening the reform of the educational management system is a necessary condition for the establishment and implementation of the university charter. Third, government participation in the making of university charter is the core of ensuring the law and effect of university charter. Fourthly, the restoration of academic power is the core requirement for the effective implementation of university charter. Fifth, establishing and perfecting the supporting mechanism and measures of the university charter is the follow-up guarantee for the effective implementation of the university charter. At the same time, the paper tries to put forward the basic model of university charter suitable for the actual situation of our country.
