高校教师职业权利的特殊性及其保护

【摘要】：现有论述的普遍性倾向是混淆了公民一般权利与教师职业权利的关系,因而使得关于教师权利保护的讨论无的放矢。本文讨论了教师职业权利的内涵及其与公民基本权利、一般民事权利的联系与区别,认为教师权利属于职业权利,具有以私权的权利为主同时兼具公权属性。针对现行教师权利保护制度存在的问题,提出明确高校教师的教育雇员地位,建立院校与民营院校统一的教师职业权利保护,完善高校教师聘任制度以及高校内部协调机制的对策建议。
[Abstract]:The general tendency of the current discourse is to confuse the relationship between the general rights of citizens and the professional rights of teachers, thus making the discussion on the protection of teachers' rights meaningless. This paper discusses the connotation of teachers' professional rights and the relationship and difference between teachers' professional rights and citizens' basic rights and general civil rights, and holds that teachers' rights belong to professional rights and have the attributes of public rights as well as the rights of private rights. In view of the problems existing in the current system of protecting teachers' rights, this paper puts forward a clear definition of the status of teachers' educational employees in colleges and universities, and establishes the unified protection of teachers' professional rights between colleges and private colleges. The countermeasures and suggestions of perfecting the system of teachers' appointment and the internal coordination mechanism of colleges and universities.
