小产权房相关法律问题的研究

【摘要】:近期都在讨论幸福感的话题,回答问题中最多的人表示有没有住房已经成为是否幸福的标准之一。随之而来的“小产权房”成为现在社会的热点问题,其产生的原因是我国土地制度的二元结构特点所决定的。该制度促使房价高升,中低层收入者购房困难,因此小产权房的产生成为了必然,同时小产权房合法化问题得到了社会各界的争议。大部分人都希望得到合法化,小产权房的合法化一方面缓和了住房问题,同时在一定程度上也缓和了社会矛盾。但是小产权房的所有权能不完整导致小产权房的很多权能实现不了,所有权中最重要的流转权问题就成为了阻碍小产权房发展的最大问题。因此,要保护买房人的权利和农民的权利就必须要使小产权房合法化。 无论是从我国宪法、物权法的相关精神来讨论,还是从我国相关制度的改革出发,小产权房的合法化无疑都是符合现行经济社会资源合理配置的要求,是践行科学发展观的有利发展方向。只有从立法上给予小产权房合法化的法律地位,从制度上健全所有权权能的规范化,才能将小产权房的合法化的问题落到实处,才能真正的实现我国经济全面快速的发展。因此对于研究小产权房合法化是有理论和现实意义的。 本文借鉴了博弈权衡分析,同时还使用了归纳法、比较分析法等方法探讨小产权房的合法化,提出小产权房合法化问题的制度构建。全文总共有四章,内容包括如下:第一章的主要内容是“小产权房”的基本问题,小产权房的现状及其存在的主要问题,其中分析了小产权房的概念界定,,小产权房的现状,“小产权房”存在的主要社会矛盾和问题,以及产生的制度根源,为本文第四章中的小产权房问题的根本解决途径提供了强有力的基础资料,进而引出小产权房产生的社会原因。第二章的主要内容是“小产权房利益均衡分析”,通过分析政府与农民之间、房地产开发商与农民之间、农民集体与农民之间、政府与政府之间、买受人等各个利益主体的利益权衡来分析说明产生小产权房最根本的原因。第三章的主要内容是“小产权房”是否合法的分析,从小产权房是否合法化的争议提出小产权房合法的理由,最后笔者得出小产权房合法化的分析,说明合法化是社会经济发展的必然趋势。第四章的主要内容是“小产权房”合法化的制度构建,本章主要是从完善“小产权房”合法化问题的立法,完善小产权房各种权能规范化,完善流通转让的区别对待制度等方面来解决小产权房合法化的问题。此章节为小产权房问题的解决提出了建议和意见,由此说明小产权房合法化是可行的,是社会经济发展的必然趋势。
[Abstract]:Recently, the topic of happiness has been discussed, and the people who answered most of the questions said that housing has become one of the criteria for happiness. The consequent "small property housing" has become a hot issue in society today. The reason is determined by the dualistic structure of the land system in our country. This system promotes the rise of house prices and the difficulties for those with middle and low incomes to buy houses. Therefore, the production of small property rights houses becomes inevitable. At the same time, the issue of legalizing small property houses has been controversial from all walks of life. Most people want to be legalized. On the one hand, the legalization of small property houses alleviates the housing problem. At the same time, to a certain extent, it alleviates social contradictions. However, the ownership of small property houses can not be complete, leading to the realization of many of the rights of small property houses. Therefore, in order to protect the rights of buyers and farmers, it is necessary to legalize small property houses. Whether it is discussed from the relevant spirit of our constitution, property law, or from the reform of the relevant system of our country, the legalization of small property right houses is undoubtedly in line with the requirements of rational allocation of economic and social resources. It is the beneficial development direction of practicing the scientific development view. Only by legalizing the legal status of the small property house in legislation and standardizing the right of ownership from the system, can the legalization of the small property house be put into practice. Therefore, it is of theoretical and practical significance to study the legalization of small property right housing. This paper uses game analysis, inductive method and comparative analysis method to discuss the legalization of small property right house, and puts forward the system construction of legalization of small property right house. There are four chapters in this paper. The content includes the following: the main content of the first chapter is the basic problem of "the small property house", the present situation of the small property house and its main problems, in which the definition of the concept of the small property house is analyzed. The present situation of the small property right house, the main social contradictions and problems existing in "the small property right house", and the system root cause, have provided the powerful basic data for the fundamental solution way of the small property right house problem in the 4th chapter of this article. The second chapter of the main content is "the analysis of the benefit balance of the small property house", through the analysis between the government and the farmer, the real estate developer and the farmer, the farmer collective and the farmer, Between the government and the government, the interests of the buyer and other stakeholders to analyze and explain the most fundamental reasons for the production of small property housing. Chapter III is the main content of the "small property housing" legal analysis, From the dispute on whether to legalize a small property house, the author puts forward the reasons for the legalization of a small property house. Finally, the author draws an analysis of the legalization of a small property house. It shows that legalization is the inevitable trend of social and economic development. The main content of Chapter 4th is the construction of legalization system of "small property right", this chapter is mainly from perfecting the legislation of legalization of "small property right". To solve the problem of legalization of small property house, this chapter puts forward some suggestions and suggestions for the solution of the problem of small property house, such as perfecting the standardization of various kinds of power of small property house, perfecting the differential treatment system of circulation and transfer, etc. to solve the problem of legalization of small property house. This shows that the legalization of small property is feasible, is the inevitable trend of social and economic development.
