房地产市场中的政府规制研究

【摘要】:随着我国的房地产市场的不断发展,房地产业被确立为国民经济的支柱性产业,然而在房地产业的地位的被逐渐提高的同时,伴随着市场出现的高房价问题越来越引起社会的广泛关注。由于长期以来没能正确处理好市场与政府的关系,造成政府的过度干预,不能有效地解决房地产市场非理性的繁荣状态。面对不稳定的房地产市场,一方面,由于市场自我调节的缺陷,需要国家运用经济职能加以调节;另一方面,由于法规政策的不完善,房地产市场的稳定发展也需要国家完善相关制度和程序。由于近些年的国家的调控与规制政策未达到应有的效果,本文从分析房地产市场政府规制的相关理论及政府调控角色入手,目的是通过研究房地产市场规制的现状及出现的问题,加上借鉴国外的经验,阐述在未来的房地产市场中,政府如何在法治环境下依法规制,从而解决房地产市场的非理性繁荣状态,促进社会民生进步。 本文通过对经济学及法学理论的学习与分析,运用文献研究法,对与房地产市场规制及政府责任相关的文献进行搜集、整理和研究分析,总结出不同学者对房地产市场调控政策的看法,以及政府规制行为的不同分析与对策建议,对于我的研究大有启发。此外,论文还运用规范研究与实证研究的相结合的方法。通过分析房地产市场的近几年发展情况及国家实施的政策效果,分析政策调整带来的问题,得出对房地产市场规制的经验;加上运用实证研究方法,分析通过国家统计局给出的数据,在对这些数据进行分析、整理之后,展开文章的论述。 由于市场固有的自我调节的缺陷性,有必要发挥经济法确认和规范政府的经济职能和权力的作用,维护市场秩序,稳定经济发展;另一方面,由于相关法规及规章制度的不完善,政府在规制房地产市场过程中出现规制失当的行为,主要有政府的行政干预过度但经济手段使用不力,政府的管理不规范及中央与地方政府的利益博弈问题,导致没能正确处理好房地产市场与政府的关系,政府调控及规制的效果不能满足市场的需求,房价呈现不减反而增的趋势,房地产市场持续过热。为此,需要防止政府对市场机制的不当干预,正确处理好“看得见的手”与“看不见的手”的关系,促进商品房市场稳定发展。 在积极倡导建设法治政府的今天,需要充分发挥经济法中确认和规范政府的经济职责和权力的作用,维护房地产市场秩序,稳定经济发展,防止政府对市场机制的不当干预,明确政府的管理权限,达到完善商品房市场以满足经济发展与民生的需求。因此,全文通过明确房地产市场相关规制理论,明确政府规制的宪法正当性,以及政府规制的角色定位,了解我国现阶段房地产市场发展状况及出现的问题,,并分析国外政府对房地产市场规制的情况,借鉴吸收国外的规制经验,不仅要有完善的政策措施,还有加强政府执法与管理,发挥政府在保障房建设方面的主导作用,最终落脚点在于吸收经验、完善措施,为房地产市场稳定发展不断努力。
