论美国食品标签制度以及对中国的启示

【摘要】：食品安全不但与老百姓的生命健康息息相关,还与国家的经济发展、政治稳定密不可分。食品标签制度就是确保食品安全的一个有效途径。我国的食品标签制度起步较晚,发展中还存在一定问题。本文通过分析美国的食品标签制度,借鉴其好的经验以完善我国的食品标签制度。本文的创新之处在于,笔者将研究的方向定在食品标签这个相对小的范围。从食品标签的角度出发研究如何规范食品生产经营企业,进而保障食品安全。而大部分学者都是直接从食品安全这个宏观的角度出发研究问题,缺乏对食品标签制度的研究,导致我国食品标签立法的滞后。本文的结构如下：第一章：美国食品标签概述。该部分从食品标签相关定义、美国食品标签管理机构、美国食品标签法律法规体系、美国食品标签制度的特点、美国食品标签制度的意义五个方面系统阐述了美国的食品标签制度。第二章：美国食品标签制度的优越性。该部分从立法和实践两个层面论述了美国食品标签制度的优越性。立法层面的优越性主要从三个方面进行论述：食品标签种类多、标准高；食品标签相关术语界定清晰；违反食品标签规定处罚力度大。实践层面的优越性主要三个方面进行论述：政府、企业、消费者。第三章：美国食品标签制度对我国的启示。通过对比分析美国食品标签制度与中国食品标签制度,得出我国食品标签制度需要从立法和实践两个层面进行完善。立法层面的启示主要从四个方面进行论述：丰富食品标签种类、提高标准度；界定食品标签相关术语；提高食品标签违法犯罪的制度惩罚成本；建立食品安全奖惩机制。实践层面的启示主要从三个方面进行论述：政府、企业、消费者。
[Abstract]:Food safety is not only closely related to the life and health of the common people, but also closely related to the economic development and political stability of the country. Food labelling system is an effective way to ensure food safety. China's food labelling system started late, there are still some problems in the development. By analyzing the food labelling system in the United States and drawing on its good experience, this paper consummates the food labelling system in China. The innovation of this paper is that the author focuses on the relatively small range of food labelling. From the point of view of food labelling, this paper studies how to standardize food production and management enterprises to ensure food safety. Most of the scholars are directly from the perspective of food safety, the lack of food labelling system research, leading to the lag of food labelling legislation in China. The structure of this paper is as follows: chapter 1: Overview of food labelling in the United States. This part from the food labelling related definitions, the United States food labelling regulatory agencies, the United States food labelling laws and regulations, the characteristics of the United States food labelling system, The significance of American food labelling system is expounded in five aspects. Chapter two: the superiority of American food labelling system. This part discusses the superiority of American food labelling system from the aspects of legislation and practice. The advantages of legislation are mainly discussed from three aspects: many kinds of food labels, high standards; clear definition of food labelling related terms; strong penalties for violations of food labelling provisions. The advantages of the practical level of the main three aspects: government, enterprises, consumers. Chapter three: the enlightenment of American food labelling system to our country. By comparing and analyzing the American food labelling system and the Chinese food labelling system, it is concluded that China's food labelling system needs to be perfected from the two aspects of legislation and practice. The enlightenment from the legislative level is mainly discussed from four aspects: enriching the food labelling categories, improving the standard degree; defining the food labelling related terms; increasing the system punishment cost of food labelling illegal crime; establishing food safety reward and punishment mechanism. The enlightenment of practice level is mainly discussed from three aspects: government, enterprise and consumer.
