企业知识产权协同保护策略研究

【摘要】：各国际条约以及学者对于知识产权对象的界定直接或间接影响了企业的知识产权策略。鉴于知识产权制度的特点,文章提出"知识产权协同保护"的概念及其意义。以美国华特迪士尼公司、美国孟山都公司、德国拜尔公司等国外企业的知识产权协同保护实践为中心,重点阐述了著作权与商标权协同保护策略、专利权与商标权协同保护策略。最后为我国企业的知识产权协同保护实践提出积极寻求知识成果的知识产权保护、扩大知识成果的适用领域、在专利存续期间积极增加商标权的价值等借鉴和学习的途径。
[Abstract]:International treaties and scholars' definition of intellectual property directly or indirectly affect the intellectual property strategy of enterprises. In view of the characteristics of the intellectual property system, this paper puts forward the concept and significance of the cooperative protection of intellectual property rights. Focusing on the cooperative protection of intellectual property rights of American Walt Disney Company, Monsanto Company and Bayer Company of Germany and other foreign enterprises, this paper focuses on the cooperative protection strategy of copyright and trademark rights. The cooperative protection strategy of patent right and trademark right. Finally, the author puts forward some ways to actively seek the intellectual property protection of knowledge achievements, expand the applicable fields of knowledge achievements, and actively increase the value of trademark rights during the period of patent existence for reference and study for the cooperative protection practice of intellectual property rights of Chinese enterprises.
