全球数字贸易治理体系构建过程中的美欧分歧

【摘要】：近年来,数字贸易发展迅猛,已经成为全球经济的新增长点。美国和欧盟是全球数字贸易治理体系构建过程中两个重要的参与者,甚至是核心引领者。但由于二者在数字产业竞争力、文化传统、民族心理等方面存在显著差异,因而对于数字贸易治理方面的利益诉求存在严重分歧。通过对比美欧差异化的主张,分析其矛盾焦点及背后成因,着力于回答好3个关键性议题,即"跨境数据自由流动""数据存储本地化"和"个人隐私保护",并尝试把握全球数字贸易规则的发展趋势,为中国数字贸易规则的制定提供借鉴。
[Abstract]:In recent years, the rapid development of digital trade has become a new growth point of the global economy. The United States and the European Union are two important participants, even the core leaders, in the process of building a global digital trade governance system. However, there are significant differences in the competitiveness of digital industry, cultural tradition, national psychology and so on, so there are serious differences in the interests of digital trade governance. By comparing the differences between the United States and Europe, the author analyzes the focus of the contradiction and the causes behind it, and tries to answer three key issues. That is, "the free flow of cross-border data", "localization of data storage" and "personal privacy protection", and attempts to grasp the development trend of global digital trade rules to provide reference for the formulation of digital trade rules in China.
