【摘要】:在法律人类学视域下,成长于特定历史语境和历史实践中的族群法治知识,亦同时构成了现代民族国家建构的本土性资源。族群法治知识这一概念的问世,不仅是基于田野调查之现实需求,同时也兼具理论参照意义。在西部J自治县进行的田野调查表明,族群法治知识的运转逻辑已由"乡土中国"逐步向"国家在场"靠拢。在实现民族地区社会治理现代化的进程中,应充分尊重族群法治知识的时空转向和路径依赖,并在此基础上寻求族群法治知识与官方法律表达之间的融通与共治。
[Abstract]:From the perspective of legal anthropology, the knowledge of ethnic group rule of law, which grew up in the specific historical context and historical practice, also constitutes the native resources of the construction of the modern nation-state, and the concept of the knowledge of the rule of law of the ethnic group came out. It is not only based on the actual needs of field investigation, but also has theoretical reference significance. The running logic of the knowledge of ethnic groups' rule of law has gradually moved from "native China" to "the presence of the state" and is in the process of realizing the modernization of social governance in ethnic areas. We should fully respect the time and space turn and path dependence of the knowledge of ethnic group rule of law, and seek the fusion and common governance between the knowledge of ethnic group rule of law and official legal expression on this basis.
