社会协同治理的法治意涵探析

【摘要】：作为国家治理的重要组成部分,当代中国的社会治理体现了国家治理方式由统治、管理到治理的大趋势。与社会管理相比,社会治理追求多元价值目标,强调党和政府、自治组织、社会公民在治理过程中的协调互补。适应社会治理的发展进程,法治不仅是社会治理的重器,也是社会善治的前提。而推动社会治理的法治化进程,需要社会治理的多元主体在法治精神引领下,以法治秩序的实现作为目标,用法治思维谋划社会治理的过程,用法治方式调节社会关系、解决社会问题,强化法律在化解社会矛盾中的权威地位,最终形成在法制轨道上实现社会良治。
[Abstract]:As an important part of national governance, social governance in contemporary China reflects the general trend from governance, management to governance. Compared with social management, social governance pursues multi-value goals. The party and government, autonomous organizations, social citizens in the governance process of coordination and complementarity, adapt to the development process of social governance, the rule of law is not only the heavy organ of social governance. It is also the premise of good social governance. To promote the legal process of social governance, it is necessary for the pluralistic subjects of social governance to take the realization of the order of the rule of law as the goal under the guidance of the spirit of the rule of law. The process of social governance is planned by the thinking of rule by law, the social relations are regulated by the way of rule by law, the social problems are solved, the authoritative position of law in resolving social contradictions is strengthened, and the good governance of society is finally formed on the track of legal system.
