【摘要】： 萨孟武的民主宪政观,是对孙中山“五权宪法”思想的直接继承和全面发挥。它直接继承了孙中山“五权宪法”思想的核心要素,即实行权能分别.造就万能政府。同时,它还全面发挥了孙中山“五权宪法”思想的鲜明特点,既吸收了西方现代法律思想,又发扬了中国传统政治制度。萨孟武生于中国开始出现大变局的时代,晚清的进一步衰落与西方资本帝国主义的兴盛形成强烈对比,要求改变残酷现实成为志士仁人的共同愿望,也成为萨孟武提出自己的民主宪政观的直接动力。中华民国建立之后,社会风气日益开放,各种政治思潮如雨后春笋般出现,这让萨孟武看到了中国政治现代化的曙光。他所提出的民主宪政观正是这一历史潮流的缩影。本文通过对萨孟武民主宪政观的系统考察以及对《五五宪草》的个案研究,说明萨孟武的民主宪政观,是一种建立在实现民主政治基础上的宪政观,是一种区别于西方三权宪法的宪政观。这一宪政观,既是人治和法治结合的产物,又是民主与独裁结合的产物,更是西方三权宪法与中国传统政制的结合的产物,它的最终目标就是,实现“政府有能,人民有权”,推动政治现代化向前发展。
[Abstract]:Samengwu's view of democratic constitutionalism is the direct inheritance and full play of Sun Zhongshan's thought of "five powers Constitution". It directly inherits the core element of Sun Zhongshan's thought of "five powers Constitution", that is, the implementation of power and power, and forms the omnipotent government. At the same time, It also gave full play to the distinct characteristics of Sun Zhongshan's "five powers Constitution" thought, which not only absorbed the modern western legal thought, but also carried forward the traditional Chinese political system. The further decline of the late Qing Dynasty contrasted strongly with the prosperity of Western capital imperialism, and demanded that the cruel reality be changed into the common aspiration of the people with lofty ideals. After the founding of the Republic of China, the social atmosphere became increasingly open and various political trends sprang up. This makes Samengwu see the dawn of Chinese political modernization. His view of democratic constitutionalism is a microcosm of this historical trend. It shows that Samengwu's view of democratic constitutionalism is based on the realization of democratic politics and is different from the constitutional view of the three powers of the West. This view of constitutionalism is the product of the combination of the rule of man and the rule of law. It is also the product of the combination of democracy and dictatorship, and the combination of the three powers constitution of the West and the traditional Chinese political system. Its ultimate goal is to realize "the government has the ability and the people have the right" to promote the development of political modernization.
