王船山论法治与政治权威的互动

【摘要】:船山学研究史上,关于船山是“人治论者”还是“法治论者”一直聚讼不已,其中的关键在于没有把握理解船山法治思想的钥匙,即法治与政治权威的互动。船山法治思想中的一个非常重要的内容就在于船山认识到了法治与政治权威之间互动的关系。这一认识主要体现在三个方面:第一,船山声称“任人任法,皆言治”,揭示了政治权威与法治的辩证联接;第二,船山主张“法者非必治,治者其人也”,强调了政治权威在法治中的重要作用;第三,船山宣扬“法善以待人,则人之失者鲜矣”,凸显了良法对于制约政治权威的重要性。全面、完整、准确地把握这三个方面的内容才是正确理解船山的法治思想的关键,而不应该各执一端、莫衷一是。
[Abstract]:In the history of Chuanshan study, there has been a great deal of litigation about whether Chuanshan is a "rule of man" or a "rule of law", the key of which is that the key to understanding Chuanshan's thought of rule of law is not assured. That is, the interaction between the rule of law and political authority. A very important content in Chuanshan's thought of rule of law is that Chuanshan recognizes the interactive relationship between the rule of law and political authority. This understanding is mainly reflected in three aspects: first. Chuanshan claims that "all people should be ruled by law", which reveals the dialectical connection between political authority and the rule of law. Second, Chuanshan advocated that "the rule of law is not necessarily the rule of law, the rule of law is also", emphasizing the important role of political authority in the rule of law; Thirdly, Chuanshan advocated that "if the law is good to treat others, then the person who has lost is rare", which highlights the importance of the good law in restricting political authority. It is comprehensive and complete. Accurately grasping the contents of these three aspects is the key to correctly understand Chuanshan's thought of ruling by law.
