《光明日报》典型法制案例报道研究（1998-2016）

【摘要】：随着我国社会主义法治建设进程的不断推进,近年来,如聂树斌案、复旦投毒案等一系列典型法制案例报道越来越多地受到党和政府的重视,在受众中也得到了广泛地关注。典型法制案例报道意义重大,可以以活生生的法制案例给受众以形象生动的教育,唤醒人们的法律意识,起到潜移默化的作用。正是基于此,媒体特别是党报,充分意识到典型法制案例报道的重要性,但同时在报道中也出现了些许问题。然而,根据笔者对“典型法制案例报道”这一关键词所做的学术史梳理来看,学界对此的研究几乎是一个空白。中国知网数据库中,对于法制案例报道的论文也只有7篇,主要是对法制案例报道的新闻选择、价值、及物性系统研究、功能等方面进行研究。《光明日报》作为新中国成立之初由民主同盟创办的以知识分子为主要对象的报纸,承担着贯彻党中央的方针政策、宣传无产阶级文化思想的任务。因此,《光明日报》自创生以来就独树一帜,与其他中共党报相比具有鲜明的特征,其典型法制案例报道也有其鲜明的特征。本研究选择以《光明日报》典型法制案例报道(1998—2016)为文本,从文本分析的角度,对《光明日报》典型法制案例报道进行探究,通过这一研究,以求填补典型法制案例报道及《光明日报》典型法制案例报道的空白。本研究主要分为四个部分:第一部分主要概述研究对象、研究意义、研究现状、研究方法及研究范围的界定等。第二部分通过量化分析、文本分析,对《光明日报》典型法制案例报道进行具体的研究。学术上,通常将“法制报道”分为刑事法制、民事法制、经济法制、文教法制、行政法制5类报道,据此,本研究也将典型法制案例报道分为这5类进行探析,即从典型刑事法制案例报道、典型民事法制案例报道、典型经济法制案例报道、典型文教法制案例报道、典型行政法制案例报道五个角度来研究;分别从体裁分析、版面分布、报道主题等三个方面对五种典型法制案例报道进行文本分析;在对每一类典型法制案例报道研究中,都分别选取了具体典型法制案例来分析,依次选取聂树斌案、张海超开胸验肺事件、三鹿奶粉事件、复旦投毒案、苍南城管打人事件五个具体案例,以更加深入地对《光明日报》典型法制案例报道进行探析。第三部分主要总结了第二部分对于《光明日报》文本分析的内容,然后从整体上来分析其中三个角度的变化趋势;其次从整体上分析了《光明日报》典型法制案例报道(1998—2016)的主题话语变迁与措辞风格变化。第四部分主要是通过对《光明日报》典型法制案例报道研究,为党报如何做好法制新闻报道提出对策与建议,主要从遵从“受众本位论”,体现自身特色;提高新闻工作者法律素养,增加受众法律知识;利用好“媒介偏向理论”,与新媒体互动等三个方面来阐述。在全球化的大背景下,当下的中国正处于一个转型时期,即正处于实现“中国梦”的关键时期,与时俱进地审视当前党报典型法制案例报道的“精华”或“糟粕”,有助于新闻界认识到典型法制案例报道的传播效应的优缺点,以及受众的情感共鸣和理性认知,以便于促使媒体更好地履行普法教育、舆论监督等职责。

The typical legal case reports of great significance, can give the audience with vivid education in the case of living law, arouse people's legal consciousness, play a subtle role. However, according to the author of "the typical legal case report" keywords sort of academic history, research in this field is almost a blank. The fourth part is mainly through the study of typical case report on "legal countermeasures and Guangming Daily." the suggestions for how to do the legal news reports, mainly from the following "audience centered theory", reflecting their own characteristics; improve journalistic legal literacy, legal knowledge to increase the audience; make good use of" The theory of "media bias, and three aspects of interactive new media to elaborate.
