我国政府治理法治化研究

【摘要】：政府治理法治化是在市场经济条件的培育下发展、壮大的,没有市场经济就没有政府治理法治化。中国共产党第十八届中央委员会第三次全体会议提出政府治理,我国政府治理法治化从此提上了日程。政府治理法治化的目的是建立法治政府,维护公民的合法权益,构建“强政府、大社会”的结构模式,提高政府治理水平,促进国家繁荣富强,确保社会和谐发展。现在我国政府治理法治化还存在许多不足:政府治理法治化程度不高;政府行政权力运行缺乏规则约束;电子政务法治化水平不高;政府治理中行政权力监督不健全。为此可从以下几方面加以完善:实现我国政府治理理念现代化;促进我国政府治理职能法治化;促进我国政府治理信息化;实现我国政府治理监督机制法治化等。本文共包括三个部分。第一部分是对我国政府治理法治化的理论阐释,概括整理了我国政府治理法治化学说和观点,对我国政府治理法治化的概念、特征、功能和构成要素作了详细的梳理。第二部分研究了我国政府治理法治化现状及问题,认为政府治理法治化程度不高,政府行政权力运行缺乏规则约束,电子政务法治化水平不高,政府治理中行政权力监督不健全。第三部分探讨了我国政府治理法治化的完善途径,认为应当实现我国政府治理理念现代化,促进我国政府治理职能法治化,促进我国政府治理信息化,实现我国政府治理监督机制法治化。
[Abstract]:The government governance by law is to cultivate in a market economy under the development and expansion of the market economy, there was no government governance by law. The government governance by law is to establish the rule of law government safeguarding the legitimate rights and interests of citizens, building a "strong government structure, mode of society, improving governance, promote national rich, strong and prosperous, ensuring the harmonious development of the society. Now the governance of government under the rule of law in China still has many problems: the government law governance level is not high; the lack of administrative power operation rules; E-government law the level is not high; government governance of administrative power supervision is not perfect. This can be improved from the following aspects: the realization of our governance concept of promoting modernization; In the function of legalization of government governance in our country; promote our government informatization; the realization of China's government supervision mechanism of rule of law. This paper consists of three parts. The first part is to explain the theory of rule of law of our country government, the general order of the rule of law and government chemical point of governance in China, characteristics of the concept. The Chinese government governance of the rule of law, the function and the elements a detailed review. The second part discusses the Chinese government law governance status quo and problems that the government law governance level is not high, the lack of administrative power operation rules, the E-government law level is not high, the government administrative power management supervision sound. The third part discusses the ways to improve the governance of the government under the rule of law in our country, our country should realize that the concept of governance modernization, promotes the legalization of government governance in our country, to promote our country The government manages information to realize the rule of law of government administration and supervision in our country.
