“一带一路”倡议下中国文化产品出口的法制思考

【摘要】:随着全球化的深入发展,文化贸易正日益成为国际贸易的重要组成部分。中国有着悠久的历史文化传统,尽管文化贸易增速较快,但总量和内容都有待提升和扩展,同时还面临着国内法律体系不健全、国际法律理念围绕促进文化自由贸易与强化文化保护的重大分歧的严峻挑战。中国应借鉴日本、美国、韩国、英国等文化出口大国完善国内法律体系,克服国际法律困境的成功经验和有效做法,紧紧抓住"一带一路"倡议深入推进的机遇,通过制定《文化产业促进法》规范文化产品出口,转变政府职能并改革文化管理体制,有效利用国际贸易救济与争端解决机制,打破市场准入壁垒等措施提升中国文化产品的国际竞争力,大力发展与沿线国家的文化贸易。
[Abstract]:With the further development of globalization, cultural trade is increasingly becoming an important part of international trade. China has a long history and cultural tradition, although the growth rate of cultural trade is relatively fast, the total amount and content need to be promoted and expanded. At the same time, it also faces the severe challenge of imperfect domestic legal system and international legal concepts surrounding the major differences in promoting cultural free trade and strengthening cultural protection. China should draw lessons from Japan, the United States, and South Korea. The successful experiences and effective practices of Britain and other major cultural exporting countries in perfecting the domestic legal system, overcoming the dilemma of international law, and seizing the opportunity of further advancing the "Belt and Road" initiative, By formulating the Cultural Industry Promotion Law to regulate the export of cultural products, to change the functions of the government and to reform the cultural management system, and to make effective use of the relief and dispute settlement mechanism of international trade, Measures such as breaking barriers to market access will enhance the international competitiveness of Chinese cultural products and vigorously develop cultural trade with countries along the border.
