论网络反腐过程中的官员名誉权保护

【摘要】：正在网络反腐过程中,网络监督权和官员名誉权的保护在一定程度上成为一对矛盾:对监督权规制过度,就可能导致对网络言论自由的剥夺以及对公民监督权的压制;规制不够,就可能会导致监督权的滥用,进而对官员名誉权等其他法定权益造成侵害,也不能体现民主法治精神的本义。因此,必须通过适当的措施对网络监督行为进行规范,在不侵害言论自由和公民监督权的前提下,对官员的名誉权进行有效的保护:(1)完善
[Abstract]:Is in the process of network anti-corruption, network supervision officials and the protection of the right of reputation as a contradiction to a certain extent: excessive oversight of regulation, it may lead to the freedom of speech on the Internet and the suppression of deprivation of the citizen right of supervision; regulation is not enough, it may lead to the abuse of supervision, and encroach on official right of reputation and other legal rights and interests, and can not reflect the original meaning of the spirit of democracy and the rule of law.
