中英科技奖励法制比较研究

【摘要】：随着科学技术的发展与进步,科技奖励活动广泛开展,制定有关科技奖励的法律成为社会发展的必然趋势。我国目前有关科技奖励的法律规范有：《国家科学技术奖励条例》、《社会力量设立科学技术奖励管理办法》、《中华人民共和国科学技术进步法》等,科技奖励法制基本形成,但是随着科技奖励的普遍开展,已经形成的科技奖励体制和具体工作也出现了一些问题。英国与中国的政治、经济背景不同,历史文化传统不同,科技奖励体制不同,经济和科技发展水平也不相同,这就决定了中国和英国科技奖励法制的不同。总体来说,英国的科技水平先进,科技奖励比较发达,因此,比较中英两国科技奖励法制的不同,对中国借鉴英国的先进经验,进一步完善中国科技奖励法制有着重要作用。本篇论文运用比较法、实证分析的方法,探析了中英两国的科技奖励在奖励主体、奖励对象、奖励形式以及评审方式上的差异。通过比较指出我国科技奖励的不足,提出了完善我国科技奖励法制的建议。除引言和结语外,论文的主要内容包括六个部分。第一部分介绍了科技奖励法制的作用及两国科技奖励法制的发展第二部分对中英两国科技奖励的法律主体进行了比较分析,并且分析了科技奖励主体的差异及其原因,以及这种差异对中国的启示。第三部分比较分析中英两国科技奖励的对象,奖励对象的差异以及对中国的启示。第四部分是对中英两国科技奖励形式的比较分析,通过分析指出两国科技奖励形式的差异,及这种差异对中国的启示。第五部分从中英两国科技奖励评审程序进行比较分析,指出差异以及对中国的启示。第六部分提出了完善我国科技奖励法制的建议。
[Abstract]:With the development and progress of science and technology, science and technology award activities are widely carried out. Formulating laws on scientific and technological awards has become an inevitable trend in social development. At present, the legal norms on scientific and technological awards in China are: regulations on State Science and Technology Awards, measures for the Administration of the Establishment of Science and Technology Awards by Social Forces, and China. Law of the people's Republic of China on the Progress of Science and Technology. The legal system of science and technology awards has basically formed, but with the widespread development of science and technology awards, there have also been some problems in the system and concrete work of science and technology awards that have been formed. Britain and China have different political, economic, historical, cultural and traditional backgrounds. Science and technology reward system is different, and the level of economic and technological development is also different. This determines the difference between China and the United Kingdom in science and technology award system. Generally speaking, Britain is advanced in science and technology, and science and technology awards are relatively developed. Therefore, Comparing the differences between China and Britain in science and technology award system, it plays an important role for China to learn from Britain's advanced experience and to further improve China's science and technology reward system. Using the comparative method and empirical analysis method, this paper analyzes the differences between China and Britain in the subject, object, form and evaluation of the science and technology award, and points out the deficiency of the science and technology award in our country. Some suggestions are put forward to perfect our country's science and technology reward legal system. In addition to the introduction and conclusion, the main content of the paper consists of six parts. The first part introduces the role of the science and technology reward system and the development of the science and technology reward system in the two countries. In the second part, the author makes a comparative analysis of the legal subjects of science and technology awards between China and Britain, and analyzes the differences of the subjects of science and technology awards and their causes, as well as the enlightenment of the differences to China. The third part compares and analyzes the object of science and technology award between China and Britain, the difference of reward object and its enlightenment to China. The 4th part is a comparative analysis of the forms of science and technology awards between China and Britain, and points out the differences between the two countries and their enlightenment to China. The 5th part makes a comparative analysis on the process of science and technology award evaluation between China and Britain, and points out the difference and its enlightenment to China. The 6th part puts forward the suggestion of perfecting our country's science and technology reward legal system.
