讲法治的法理学家:胡适对先秦法家的理解

【摘要】：胡适是中国现代思想史上聚光灯式的人物。胡适对先秦法家的理解,既是其思想的一个组成部分,也是重新认识中国法治与中国法家的一个切入点。胡适以西方学术的视野理解法家,以"讲法治的书"与"法理学家"定性法家。胡适对法家之名的质疑,对法家身份的认定,对法家人物的辨析,对法家哲学的分述,对法治逻辑的梳理,对"韩非学"的概括与归纳,都具有思想史意义。胡适关于法家的著述主要集中在1917年前后。在一百年后的今日回望胡适描绘的法家思想肖像,不仅有助于接续先哲学思,而且可以为法家学说与法治理论的再研究确立一个不容忽视的思想参照。
[Abstract]:Hu Shi is a spotlight figure in the history of modern Chinese thought. Hu Shi's understanding of the Legalists in the Pre-Qin Dynasty is an integral part of his thoughts. It is also a starting point to reunderstand the rule of law in China and the Chinese legalists. Hu Shi understands legalists from the perspective of western academic studies, characterizes legalists with "books on rule of law" and "jurists." Hu Shi questions the name of legalists and recognizes the identity of legalists. The discrimination and analysis of the Legalists, the division of the philosophy of the Legalists, the carding of the logic of the rule of law, the generalization and induction of the study of Han Fei, Hu Shi's writings on Legalists mainly focused on around 1917. A hundred years later, looking back at the portrait of Legalism depicted by Hu Shi is not only helpful to the continuation of philosophical thinking. Moreover, it can establish an important ideological reference for the further study of Legalist theory and rule of law theory.
