【摘要】：邓小平法制思想产生于中国特定的历史背景下,对当时中国社会的发展起了巨大的促进和保障作用,产生了深刻的国内、国际影响。时至今日,邓小平法制思想中蕴含的一些经典理论,对当前的中国社会有巨大的指导和借鉴意义以及现实价值。邓小平法制思想属于广义的马克思主义法学范畴,是马克思主义法学中国化的产物,是以邓小平的法制思想为核心的中国共产党集体法制思想的结晶,也是邓小平理论的重要组成部分。邓小平法制思想在中国特殊的国内、国际背景下产生,具有承上启下的意义。邓小平法制思想吸收了国内外社会主义建设的经验教训,形成于二战以后世界范围内恢复法制建设的背景下,除此之外,我们还要特别关注其个人经历对邓小平法制思想产生的影响。邓小平法制思想是在借鉴马克思列宁主义法学理论,以毛泽东为主的中国共产党第一代领导集体的法律思想,中国传统法律文化中的法制观点等理论的基础上而逐渐成熟,自成一体。从而形成了与时代紧密结合的法制思想特色,主要包括坚持民主和法制的辩证统一关系,坚持党与法制的相互制约关系,坚持始终以经济建设为中心的法制建设原则,其核心内容是法治。邓小平法制思想涵盖内容多,涉及面很广,主要包括思想上高度重视法制的作用,实践中不断完善法制,重视普法教育和干部法制素养的提高,“一国两制”理论。在把握了邓小平法制思想的内容后,更重要的是研究邓小平法制思想的当代价值,邓小平法制思想为我国依法治国思想提供了理论支持,促进社会主义市场经济和社会主义民主政治的发展,推动深化政治体制改革,催生法学专业教育,发展壮大法律职业队伍。
