湖湘学派与息讼化争的司法风貌——兼论地方法治文化的建构

【摘要】：湖湘学派对湖南传统司法在息讼风貌上的影响,侧重在不同于具体制度层面的一种法治文化的实践之中。它通过"敦睦人伦""劝课农桑""惩治讼师"等对无讼司法风貌的造就,体现了"三个面相"上的成功;而其中揭示出,倡导核心价值的"目的因"、开放包容而不封闭孤立的"形式因"、因地制宜所本于地域性的"质料因"和法治实践承袭者的"动力因",这些都应是当下中国在地方法治文化建构中的一般性因素。
[Abstract]:The influence of Huxiang School on Hunan's traditional judicature in the aspect of interest litigation focuses on the practice of a culture of rule of law which is different from the specific system.It embodies the success of the "three facets" through the cultivation of the judicial style of "Harmony of Man", "persuading Nongsang" and "punishing the Litiers", and reveals that,The "purpose cause" that advocates the core value, the "form cause" which is open and inclusive but not the isolated "form cause", the regional "material cause" which is based on the local conditions, and the "motive factor" of the inheritor of the practice of the rule of law, all these should be the local factors of China at present.The general factors in the construction of the culture of rule of law.
