网约车市场准入法制研究

【摘要】:与传统出租车不同,网约车诞生于“互联网+”背景下之下,是出租车服务的新模式、新业态。市场准入问题是网约车监管需要应对的关键问题之一,如何创新行政管理手段,使网约车市场准入制度适应新经济的发展是一直以来网约车问题讨论的一个焦点。同时,网约车的市场准入问题不仅仅是其自身面临的困境,利用网约车这一新业态推动积弊已久的传统出租车市场准入制度改革也是问题的一个重要方面。本文除了绪论和结语之外包括以下三章内容:一、介绍了网约车的概念和特点以及传统出租车的概念和类型,并从概念性质与运营模式两个方面对网约车与传统出租车进行了比较分析,发现网约车创新的服务方式和运营模式,从而回应网约车市场准入制度设计不可套用传统出租车市场准入监管模式的问题,并对建立网约车市场准入法制的必要性进行了阐释。二、从中央与地方两个层面,对网约车市场准入法制现状和主要内容进行了实证分析,揭示了我国网约车市场准入法制主要存在四个方面的问题:(1)国家层面缺乏明确的制度安排;(2)地方层面网约车市场准入标准不一,与上位法冲突;(3)网约车与传统出租车特许经营市场准入制度存在着冲突;(4)目前的网约车市场准入监管手段无法通过比例原则的考量。三、从宏观角度提出改革网约车市场准入法制的总体思路:以“互联网+出租车”服务业法制改革为基本方向,以行政法的比例原则要求的妥当性、必要性和均衡性为基本准则,以依法保障网约车各方当事人合法权益、加强网约车市场监管、逐步推进出租车市场准入制度改革为基本目标,以实行统一的登记制和设定法定准入条件为抓手,以加强事中事后监管为保障。从微观层面对网约车市场准入法制的改革提出具体对策和建议:(1)建立网约车市场准入登记制度;(2)设定统一的网约车市场准入条件和标准;(3)明确网约车各方当事人实施市场准入标准的义务和权利;(4)有序推进传统出租车市场准入特许经营制度改革、逐步实现出租车统一登记准入制度;(5)加强对出租车运营事中事后监管。
[Abstract]:Different from the traditional taxi, it is a new model and new form of taxi service, which is born under the background of "Internet".The issue of market access is one of the key issues that need to be dealt with in the regulation of ride-sharing. How to innovate the means of administration and make the market access system adapt to the development of new economy has always been a focus of discussion.At the same time, the problem of ride-sharing market access is not only a dilemma it faces, but also an important aspect of the problem to promote the reform of the traditional taxi market access system, which has long been a drawback.In addition to the introduction and conclusion, this paper includes the following three chapters: first, it introduces the concept and characteristics of the net taxi, as well as the concept and type of the traditional taxi.And from the concept nature and the operation mode two aspects to carry on the comparative analysis to the network to share the car and the traditional taxi, discovered the network to share the car the innovation service way and the operation pattern,In order to respond to the problem that the traditional taxi market access regulation mode can not be applied in the design of the net-ride-hailing market access system, the necessity of establishing the net-ride-sharing market access legal system is explained.Second, from the central and local levels, the current situation and main contents of the legal system of market access for ride-sharing are empirically analyzed.It is revealed that there are four main problems in the legal system of market access for ride-sharing in China: (1) the lack of clear institutional arrangements at the national level; (2) the different standards of market access for ride-sharing at the local level.There is a conflict between car-sharing system and traditional taxi franchise market access system. (4) the current regulatory means of ride-sharing market access cannot pass the consideration of the principle of proportionality.Third, from the macro point of view, the author puts forward the general idea of reforming the legal system of market access for ride-hailing: taking the legal reform of the "Internet taxi" service industry as the basic direction and the appropriateness required by the principle of proportionality of administrative law,The basic goal is to protect the legal rights and interests of the parties involved in the ride-sharing network according to law, to strengthen the supervision of the ride-sharing market, and to gradually promote the reform of the taxi market access system.To implement a unified registration system and set legal access conditions as the grasp, to strengthen supervision in the event as a guarantee.Put forward the concrete countermeasure and suggestion on the reform of the legal system of the net-car market access from the microcosmic level: 1) establish the registration system of the net-ride-hailing market. (2) set up the unified market access conditions and standards of the net-ride-hailing market. 3) make clear the parties involved in the net-ride-hailing market.The obligation and the right to implement the market access standards. (4) to promote the reform of the traditional taxi market access franchise system in an orderly manner.Step by step to realize the system of uniform registration and admission of taxis and strengthen the supervision of taxi operation after the incident.
