进口网络游戏行政许可的法治化研究

【摘要】：《行政许可法》是现代行政法治的充分体现,是中国当代行政法治理念的总结与深化。现代行政法治不仅要追求形式法治,重视行政法律规范的地位和作用,而且还要关注实质法治,以确保行政法律规范的正当性,符合现代社会的价值观念,顺应历史发展潮流,符合人民群众的根本利益。也就是说,现代行政法治应当是“法律至上”与“法律正当”的有机统一 2000年以来网络游戏在我国快速发展,已经成为人民群众喜闻乐见的互联网文化娱乐活动,丰富了人民群众的精神文化生活。网络游戏的发展也存在一些内容低俗、用户权益缺乏保障、未成年人沉迷游戏等问题,政府通过主体准入、内容审查、运营监管等方面逐步加强对网络游戏的行政管理工作。由于对国务院《关于文化部、广电总局、新闻出版总署“三定”规定》(简称《“三定”规定》)中有关网络游戏行政管理的职能分工理解不同,导致文化部、新闻出版总署对进口网络游戏行政许可存在较大的争议,造成事实上的两部门重复行政许可的特殊现象。2009年全球最著名的美国暴雪娱乐公司出品的网络游戏《魔兽世界》因变更在中国地区的独家代理运营商需重新申请进口网络游戏行政许可而导致了一场全国震惊的“魔兽门”审批事件。回顾进口网络游戏《魔兽世界》的行政许可争议事件,暴露了目前我国在进口网络游戏行政许可制度中存在部委规章、规范性文件规定的冲突,有关网络游戏行政许可立法的缺失,重复行政许可所带来的不公正等问题。通过对进口网络游戏行政许可增设行政许可条件、行政许可公平原则、重复设定行政许可、有关行政许可的行政解释、延长行政许可期限、违反行政许可的行政处罚等争议问题的分析和研究,探索实现进口网络游戏行政许可法治化的途径和办法。为更好地贯彻执行《行政许可法》,落实国务院《全面推进依法行政实施纲要》的要求,本文提出完善进口网络游戏行政许可管理的建议。统一网络游戏行政许可管理,首先要解决统一“大部制”管理,避免权限冲突；其次通过规范行政许可程序,强化事后审查制度,可以减少不必要的行政许可项目。另外,尽快完善有关进口网络游戏行政许可的立法,将《“三定”规定》法定化。进一步加强对网络游戏行政许可的行为监督,建立行政许可评价制度。当然,推动有关网游戏行政许可的综合执法,需要进一步加强综合执法队伍建设,提高综合执法水平,建立行政许可管理和行政处罚相对分开的监督、制约机制。坚持对网络游戏企业合法、合情、合理的行政管理思路,努力实现国务院建设法治政府、责任政府、服务政府的目标。
[Abstract]:The Administrative permission Law is the full embodiment of the modern administrative rule of law and the summary and deepening of the contemporary Chinese concept of administrative rule of law.The modern administrative rule of law should not only pursue the formal rule of law, attach importance to the status and function of the administrative legal norms, but also pay attention to the substantive rule of law in order to ensure the legitimacy of the administrative legal norms, conform to the values of modern society and conform to the trend of historical development.It conforms to the fundamental interests of the people.That is to say, the modern administrative rule of law should be the organic unity of "law first" and "legal justice".Since 2000, the network game has developed rapidly in our country, has become the popular Internet cultural entertainment activity, has enriched the people's spiritual and cultural life.There are also some problems in the development of online games, such as vulgar content, lack of protection of users' rights and interests, minors indulging in games, and so on. The government has gradually strengthened the administration of online games through access to the main body, content censorship, operation supervision and so on.As a result of the different understanding of the division of functions concerning the administrative management of online games in the State Council's regulations on the Ministry of Culture, the General Administration of Radio, Film and Television, and the General Administration of Press and publication, the Ministry of Culture,The General Administration of Press and publication has a great dispute over the administrative licensing of imported online games.In 2009, the world's most famous American Blizzard Entertainment Company produced the online game "World of Warcraft" due to the change in the exclusive agency operators in China to re-apply.The import network game administrative license has led to a national shock, "Warcraft Gate" approval event.Recalling the dispute over the administrative licensing of imported online games "World of Warcraft", which exposed the conflicts in the current administrative licensing system of imported online games in China under the regulations of ministries and regulations and normative documents,Some problems such as the lack of legislation of online game administrative license and the injustice caused by repeated administrative license are also discussed.Through the addition of administrative licensing conditions, the principle of fairness of administrative licensing, the repeated establishment of administrative licensing, the administrative interpretation of relevant administrative licenses, and the extension of the term of administrative licensing,This paper analyzes and studies the controversial issues such as administrative penalty of violation of administrative license, and explores the ways and means of realizing the legalization of administrative license of imported online games.In order to carry out the Administrative Licensing Law better and fulfill the requirements of the State Council's outline for promoting the implementation of Law, this paper puts forward some suggestions for perfecting the administrative license management of imported online games.In order to unify the administrative license management of online games, first of all, it is necessary to solve the unified "big department" management, to avoid the conflict of authority, and secondly, to reduce the unnecessary items of administrative license by standardizing the administrative licensing procedure and strengthening the system of ex post examination.In addition, as soon as possible to improve the import of online games administrative licensing legislation, the "three definite" provisions of the law.We will further strengthen the supervision of the administrative license of online games and establish an administrative license evaluation system.Of course, it is necessary to further strengthen the construction of comprehensive law enforcement team, improve the level of comprehensive law enforcement, and establish a relatively separate supervision and restriction mechanism between administrative license management and administrative punishment.This paper insists on the legal, reasonable and reasonable administration of online game enterprises, and tries to realize the goal of the State Council to build a government ruled by law, a responsible government, and a government to serve the government.
